The railroads do not lind it all sunshine, in court matters. .Some times the decisions are extremely adverse to their way of thinking. The Globe-Democrat of St. Louis says that the recent decision of Judge Love, of the United States court, in the matter of Hie applica tion for an order upon the receiver of the Wabash system to suspend the operation of a non-paying rail road line in Iowa will attract gen eral notice and provoke more or less criticism. He holds that rail reals, beins; public conveyances an 1 private carriers, owe certain obligations to their patrons which! they can not be allowed to escape by taking up their track and retir ing from business. The right to build a road through private prop erty involves the duty of providing transportation for the public, lie declares, and that duty is a per manent one, and must be per formed regardless of the question of profit. "Courts have no right," he insists, "to deprive people of this transportation on the showing that the road does not pay ex penses." The fict that, a road fails to make money is a misfor tune, but not a legal reason for abandoning it. according to his view of the matter. If the owners of the property haw made a bad bargain, they must abide by if, and cxtiicate themselves fro.n the difficulty by some other method tha.i .hat of discontinuing userviee whie'i they aree t j render whe i they obtained their charter a'-.d right of way. In other words, w hen a railroad is built the public aci'iires a vested right in ilsopeta- j t ion, and s;iid tight ea not lo j destroyed. It is certainly a novel I January next shall be free. Ths is considered the greatest conces sion that a .Mussulman prince has ever made to a Emopeati. Joaquin iln.i.KK is evidently becoming somewhat of an Eli Perkins himself. After his recent trip through Oregon and Washing ton iie went home and wrote : "In Spokane Falls at the Grand Hotel I saw a little box with a few dollars of change in it out on the end of the counter in the midst of a dozen or two of the daily papers from various places. No one, so far as I ever saw, wu.? iu charge of either the papers or the morey. Any man who wanted a paper took it, tossed his tnony into the box and took whatever change was his. I set this down as an incontestable siizn of niosoeritv, and let us admit, as we bow our heads in humility to the need of tnat por tion of the LomI's prayer which says 'Leid us not into temptation' of honesty, which is the firstborn of prosperity." This seems logical and proper; but according to Judge Love's philosophy it is a'l wrong. The Spring Valley company tacitly vontracted to provide the people with coal and to furnish employ ment to miner?, and by closing its mines it violated that contract as clearly as a rail toad would evade its d.ity by tvasbigtjgivj promised means o: tia isportaticn In both iusta i i-es the pniu-iple is the sane, and the U-gitimata eiiVit of ihe p-opo iitio- liiat f;on m tv I e ie iu'i'i d ! d ITIkj City Iicslanrant, Under the n w inaiiaemeiit if II.
