Judge Love, of the United States
court, in the matter of Hie applica
tion for an order upon the receiver
of the Wabash system to suspend
the operation of a non-paying rail
road line in Iowa will attract gen
eral notice and provoke more or
less criticism. He holds that rail
reals, beins; public conveyances
an 1 private carriers, owe certain
obligations to their patrons which!
they can not be allowed to escape
by taking up their track and retir
ing from business. The right to
build a road through private prop
erty involves the duty of providing
transportation for the public, lie
declares, and that duty is a per
manent one, and must be per
formed regardless of the question
of profit. "Courts have no right,"
he insists, "to deprive people of
this transportation on the showing
that the road does not pay ex
penses." The fict that, a road
fails to make money is a misfor
tune, but not a legal reason for
abandoning it. according to his
view of the matter. If the owners
