The fact Is, the title of the act Is a lie, deliberately written in (or the purpose of causing an uncuastltu- tlonal act to muster past the coast!- utlonal Inhibition against approprl nine money for a special road In any one or more counties. There never was any Intention, either upon the part of the lobby or of the legis lature, to construct a State road from the Idaho boundary to the Pacific brief In full Is as follows: In the Supreme Court of the State of'Oregon, March term, 150. J. K. Sears, a resident and taxpayer of the State of Oregon, plaintiff and re spondent, vs. George A. Steel as treasurer and F. V. Benson as sec retary of state of the Slate of Ore gon, appellants. Respondent's brief: The legislative assembly of the State of Oregon, at Its regular bien nial session held at Salem during the months of January and February, 101, attempted to pass an act en titled "An act appropriating 1100,000 to aid In the construction of a State road from the Pacific ocean via Cra ter Lake to the Idaho boundary, and to provide lor the appointment of a commission to supervise the expendi ture of such money and to superin tend the construction of such road." On the Minidoka tract water has been promised sgaln and again nt specified period aad only a portion Is receiving water. In the same local ity the Twin Falls lands are rich In crops, the settlers prosperous and getting rich, while their Irrigated laads are making of Twin Falls one of the most substantial of Interior cities of the West. Irk of Panda lUamed. As to the Minidoka project, it Is asserted that settlers have entered on lands which comprise a large per centage oi ine tract It was originally intended to reclaim, but which are under the proposed fourth and fifth lifts, on the south side of the river In Cassia county, Idaho. It Is now declared that none of these Undo will receive water for years to come. Lack of funds, so It Is announced by the rvdamstloa oncers, will prevent the building of additional canals re quired to Irrigate the higher lands and the settlers will be forced to lose their rights or hang on and scratch for a living while neighbors but a few miles away are growing wealthy. For Irrigating tt.000 acres of Min idoka lands under the gravity sys tem proposed by the government, the original estimate was 113 an acre. Flfiy.three thousand addition acres under a pumping system were to be Irrigated at an estimated cost of it.io per acre. Later It waa found that ths cost under ths gravity sys tem woum uoi oe leas tnan 22 an acre and under the pumping system not less thsn 130 an acre. Then, too, If the settlers did not live up to the letter of the law they forfeited their claims or sold to others when not able to mako their payments. The Price was raised to ISO an acre under that section of the canal where $22 was the estimated cost Politics and civil service In the en glneerlng branch of the Reclamation Service are declared to be responsible for the failure of the government to complete Irrigation works within the tlmo promised and for errors In es timates. Political pressure. It Is asserted, has brought about the approval of too many projects for the funds available for the work. Estimates have been mads of the amount neces sary to complete the government projects now unaer way and are placed at ISMS0.600. To offset this It U estimated that the revenues rrom projects already completed will provide only about 17,000,000 for reclamation work during if 10. This amount. It Is asserted, would not complete ins rayette project alone. uaiy aoa.aoo oa Hand. The total recelnta of ths rUm. If these figures, which have been compiled by promoters of private en terprises ostensibly from government reports, are correct, there seems to bo little likelihood of the government Uklng up any new projects In Ore gon or any other Bute In the near future. As to the complaint against the en gineering service, It is asserted that the government la nutilnr mnn mn Just out of school, who receive from the government (75 or ISO a month, on the character of work for which prlrato compaolea pay engineers from 1300 a month up.
