About one-fourth of all checks and money orders received by Internal Revenue Service in Portland in the past five months had insufficient information lo adequately identify their purpose. These required research, which adds unnecessary staffing costs, lo determine where to apply the funds. In some cases this is complicated when taxpayers have more than one delin quent lax account, the news release continued. IRS asks that all tax payments be clearly identi fied The check or money order should have, in the bottom left hand corner, the taxpayer's identification number, type of tax. and time period involved. IRS also cautions that payments by mail should not te made in cash., Unless otherwise instructed by IRS personnel. Oregon residents should normally ad dress the envelope containing their paymenls to: IRS Ser vice Center. Ogden. Utah. 84201. JPUBIIC NOTICES 0 The following Ordinance was read by the Morrow County Court on March 10, 1982 for adoption. Anyone wishing to comment may contact members of the court in the Judge's office. Morrow County Courthouse, Heppner. IN THE COUNTY COURT VOK MORROW COUNTY. OREGON An Ordinance establishing Weed Control District for Morrow County, identifying noxious weeds to be controlled by said district, and establish ing procedures for control of such weeds within Morrow County, and repealing the declaration of weed control district dated October. 1937.. WHEREAS noxious weeds have become so thoroughly established and are spreading so rapidly within Morrow County as to be a menace to the public welfare, and WHEREAS, ORS 570.515 provides that a County Court may declare the County a Weed Control District for the purpose of destroying White Top, Russian Knapweed and other weeds designated as noxious and preventing the seeding and spread of such other weeds and plants as the County may declare to be noxious, and WHEREAS, the County Court has received petitions from citizens within the County requesting the County to establish a Weed Control District. THE COUNTY COURT OF MORROW ORDAINS AS FOLLOWS: Section No. 1. Morrow County is hereby declared to be a Weed Control District. The boundaries of the District shall coincide with the boun daries of Morrow County. Section No. 2. Short title. This ordinance shall be known as the Weed Control Ordi nance of Morrow County. Section No. 3. Definitions. The definitions in this section shall apply unless the context of the ordinance requires otherwise, (a) "County" means Morrow County, Ore gon, (b) "County Court" shall mean the County Court of Morrow County. Oregon, (c) "County Clerk" means the Clerk of the County, (d) "Noxious Weed" means any plant which is determined by the County Court to be injurious to public health, crops, livestsock. land or other property. The list and classification of noxious weeds is fully set forth in section 6 of this ordinance. Section No. 4. Weed inspec tor, (a) The County Court shall appoint a weed inspector whose duties shall be: 1. To find out if any noxious weeds or plants are being permitted to grow and produce bloom or seed within the County. 2. To serve notices. 3. When neces sary to cut or to supervise the destruction or cutting of the noxious weeds, growing or seeding within the county. 4. To conduct investigations, approve plans and certify expenditures pertaining to weed control projects oper ated under cost share assis tance grants, (b) The weed inspector shall have access to the land within the district, (c) When the provisions of this ordinance are not being com plied with, the weed inspector shall serve a written notice to the owner or occupant of the land. If the inspector is unable to personally serve the owner or occupant, the inspector shall post the notice and two copies thereof in three conspi cuous places on the land, (d) The notice shall contain: 1. The dated service or posting of notice. 2. The name of the weed or weeds growing on such land, and a statement selling forth that such weeds must be destroyed or preven ted from producing seed within a specified time of not less than two days nor more than twenty days, lo be established by the inspector, from the dale of service or posting of such notice, (e) A copy of such notice, together with the proof of service or posting endorsed thereon, shall be filed with the County Court. Section No, 5. Duties of property owners and occu pants, (a) Service or posting of the notice provided for in section no. 4 of this ordinance shall have the effect to require the owner or occupant of the land to destroy or prevent from seeding or spreading any weeds specified in the notice during the continuation of ownership or occupancy of the land by such person or until the district is dissolved, (b) Each person, firm, or corpor ation owning or occupying land within the county shall destroy or prevent the seeding on such land of any noxious weed classified as noxious by this ordinance, by uses of the best means at hand and within a lime declared reasonable and set by the court. No weed declared noxious shall be permitted to produce seed. Section No. 6. Noxious weeds. For the purposes of this ordinance the following weeds are declared to be noxious: Skeleton weed: Tansy Ragwort; Yellow Star Thistle. This list may be amended and updated by resolution of the Morrow County Court. It shall be reviewed annually to deter mine necessity of adding or deleting weeds from the list. Section No. 7. Weeds of economic importance. These are weeds which are of economic importance and which occur in small enough infestation to make eradica tion practicable in most of Morrow County. They may be upgraded to noxious weeds . when eradication becomes ; possible or when the economic threat becomes great enough to require total eradication. The owner or occupant of properly is required to make every practical attempt to eradicate weeds of economic importance. Weeds of eco nomic importance are: Musk Thistle: Poison Hemlock: Water Hemlock: Dodder: Halogetnn; Milk Thistle: Goat Grass: Hounds Tongue; Bar Chervil. Section No. 8. Eradication of weeds when owner or occu pant refuses to do so. I?3,q7a I OKI I 99.;as the property, the weed inspec tor shall Immediately notify the district attorney who shall lake necessary steps for enforcement, tb) The weed inspector shall also immedi ately notify the County Court who shall authorize the weed inspector and such assistants as may be necessary to go upon the land or premises and destroy the noxious weeds or control them in such manner as will destroy all seeds of such noxious weeds; however, if such destruction or control is impracticable because the weeds are too far advanced or for other reasons means of control are unsatisfactory, the inspector shall so notify the County Court, which shall request the State Department of Agriculture to immediately quarantine any such noxious weed infested farm, (c) In all cases where the weed inspec tor undertakes to destroy or control noxious weeds, the most effective and practical method, in the judgment of the inspector, and with least injury to the land and crops, shall be used, (d) Upon the completion of such work the weed inspector shall file with the County Clerk an itemized statement of the expenses necessarily incurred in the destruction of such weeds, including his or her own wages, verified by oath, (e) When the statement of ex pense is filed, the clerk shall cause it to be entered upon a lien docket prepared for that purpose, the amount of the charges and expenses when so docketed shall constitute a first lien upon such lands or premises, except as to taxes. Section No. 9. Collection of lien. If the charges and expenses are not paid and the lien discharaged by the owner within 90 days from the date the lien is docketed, the County Clerk shall certify the same to the tax collector, who shall extend the amount thereof upon the current tax rolls. When so extended, the same shall constitute a valid lien against such premises and shall be collected by the tax " collector in the same manner as taxes are collected. All liens so certified by the County Clerk to the tax collector after September 1 of each year shall be extended on the next roll delivered to the tax collector under ORS 311115. Section No. 10 Penalties. I Violation of this ordinance is a violation and is punishable, upon conviction, by a fine not to exceed $100 for each offense. Section No. 11. Emergency Clause. In as much as it is necessary for the health, safety, and welfare of the citizens of Morrow County that this ordinance take im mediate effect, ah emergency is hereby declared to exist and this ordinance shall take effect immediately after the second publication of official notice describing the district and naming the weeds to be destroyed or prevented from seeding.
