Hunt on the recent ver dict of the jury in the Oregon Pa cific damage suit, in the sum of $(5.243 5t as awarded to Mr. Hunt by the jury. This sum include? the Oregon Pacific's estimates of the work d:ne, of $75,443.50, and $800 damages. It is likely that the suit of G. W. Hunt against the Or egon Pacific in the V . S. circuit court, i Monday Judge Dc-ady allowed the j motion of the plaintiff to strike out j two of the claims for damages in; the counter claim of the defendant, ! and disal owe I ttie mo: 'on as to the j tnirJ. lie l-eid that the company! ought to be allowed to show, if j they could to the satisfaction of the j jury, what damages they sustained j by "losing the use ard operation of! the road on account of the failure ! of plaintiff to construct it. within j the time agreed upon; ami that the plaintiff was not liable to the j company for the $30,000 damages j whicii it alleges it sustained by the ; reason of the failure of the plain- j tilt' to construct the road in time, j whore by it was unable to carry j $50,000 worth ot Ireight, which it alleges it hul bargained to carry to and from the eastern end of its rial to Yaquina bay because that was a loss sustained upon a collat-. eral contract with a third person, and not within the contemplation of the parties to the contract con cerning the construction of the road; nor should the plaintiff be liable to the defen iant for $100, 000 damages as claimed by the defendant on account of the greater sum it would cost to construct the road, over the contract price, be cause it is uncertain what the coss of construction would be until it it done, as the price of labor and ma terial fluctuates, and it might be built cheaper than the contract price-the damages are to uncertain and further, it is contingent, as the company may never construct the road, and until it is constructed it cannot be told with any certainty how much more than the contract price it will cost, or a-hat the loss of the company may be. Mr. Hunt secured a judgment against the O. P. Co. in the circuit court in this city last Friday. If he has his case tried in the U. S. court he can take whichever judgment is the largest. .More Smi;i1I(o.v. Miss Baker, thesmallpox patient at the place of F. X. Matthieu, at Butteville, is reported as improv ing. Her attack was light at first. and the careful nursing she re ceived has brought her through the cisis and she is now out of danger. A gentleman who spent Sunday in Gervais informs this paper that while there he heard of several new cases of the disease that had broken out in and about Champoeg. One of the victims of the elread disease is a Chinaman who belongs to a gang of grubbers working at Yerger's place two miles from Champoeg. Another case reported is that of an old Frenchman who was taken down with the disease in its most malignant form at Menig's place near Chamoegon Wednesday. The old gentleman, whose name could not be learned had been wander- j - . . . i ' .... i ... . ing around the country, and on the Saturday night before the disease broke out on him he slept at Hon. E.J. Harding's place in an out building where about 20 men, who were working there with a straw baler, also lodged. When these men heard that their lati visitor had contracted the smallpox they were all immediately vaccinated, and but little fear is entertained of the elisease taking hold of any of them. Judge Boise was presented yes terday by Phil Cohen, of this city, with a novel thermometer, it being a genuine ear of corn with a small thermometer set in the cob. Mr. Cohen calls it a "(iranger ther mometer." It is a neat contri vance. My summer in Oregon has been delightfully spout, mostly among tiie lovely iuiii.s oi tiiu Willamette Valley and at what, is now getting to be one of the famous seaside resorts in this part oi the country, Yaqui na bay. It is really surprising to see the success which has crowned toe efforts ot the 1'i.ited ttaie gov ernment in developing the entrance of the harbor at this place. It has really opened to commerce what is no.v the fiiie.it harbor on the Pa cific coast, north of San Francisco. This is notably true for the city of Portland is 110 miles from the ocean, and Tacoma and Seattle, the ports of shipment of the Northern Pacific railroad, have to traverse Puget sound and the straits about lSo miles before the ship arrives at the ocean, while it takes only a few minutes to cross the bar at Yaquii.a bay, when the ocean is reached and the ship is at sea. The breakwater is already constructed, the deepening of the water at the bar almost completed, and I am told that the appropriation made by congress this year will render this great harbor safe at nil seasons, as the water on the bar at low tide at the present tiui is al most sufficient for vessels of the largest size. Arrangements are now in con templation for the shipment of grain direct to Furoje by the Ore gon Pacific railroad from Yaquina bay ; and the facilities of this har bor are so promising that it has al ready attracted a large intelligent 1 population. In my judgment noth ing can prevent Yaquina from be ing one of the largest cities on the Pacific coast. This is likelv to lie the ease in the near future, for with such depth, such ample room for anchorage and handling the largest vessels, the port proves its capacity for the accommodation of a vast amount of shipping. With the development of the country and the facilities for transportation furnished by the railroad having its terminus at this place, a large shipping business is already com menced, and the facilities both of shipping and raiiroad are not at ail commensurate with the freight which presses forward . 7 V ,V. uuu U1 la- ' ! The ease of getting in and out of the harbor here is remarkable. I saw a steam tug to-day bring a large three-masted schooner over the bar in about five minute. With the improvements of the bar nan an nour sumces to tug ttie ar riving vessel from the deep Pacific to her station alongside the wharf, and the same time will despatch her, fully loaded, on her outward voyage. Little towage is required here, and w ith light harbor charges this is the least expensive port on the Pacific coast. Tlie steamships of the Oregon Development Com pany are running regularly between here and San Francisco, and new steamships of large tonnage are to be put on at once.
