T h e c o u rt’s Carcieri deci sion ru led th a t th e US D e p a r tm e n t o f th e I n t e r i o r could n o t g ran t reservations for tribes th at w ere n o t “u n der federal jurisdiction” prior to 1934, a change th a t has affe c te d th e M ashpetes and dozens o f o th er tribes across the country. T h e M a s h p e e r e c e iv e d federal recognition in 2007, though the tribe is at w ork on an e ffo rt to p ro v e in its res e rv a tio n a p p lic a tio n th a t it w as u n d er federal jurisdiction m uch earlier. A “fix” to the ruling w ould reaffirm the secretary o f the in te rio r’s a u th o rity to place land in to tru st for all feder ally recognized Indian tribes, and could substantially accel erate th e tim e it could take for the M ashpee to o p en its p ro p o se d $500 m illion desti n a ti o n r e s o r t c a s in o in T aunton. T h e p ro p e rty a t the site o f th e p ro p o se d casino in T aunton m ust be taken into to tru st before gam ing opera tions can begin.
