The provisions of the Tori-ens land act of Colorado, recently upheld by the unreme court of that state, are similar to the Torrens law in Oregon, and the decision of that court therefore becomes of peculiar Interest here. Attorney Bob- en j, wngnt nas anaiysea me opinion of the Colorado oonrt and expresses his views in the following Interview: "By reason of a great many .real as- , tate transactions being made all tha time, it will be Interesting td those who have taken advantage of the Torrena law to know about some points decided In tha latest decision of a - supreme court The Torrens law has been In ef fect in Oregon for several years now and was adopted by Washington at its last legislature. .- "The supreme court of Colorado is the last court which has spoken upon It, and this was in tha case of People x rel Smith vs. Crissman, registrar of titles, decided last, .December. Tne de cision was unanimous on all points. Oregon Act Comprehensive. "Briefly stated, the court decided up on an objection that the title of the mnt which is. 'An aot concerning titles.' did not sufficiently describe the legis lation contained tnerem, was witnoui merit Our Oregon acta has a more comprehensive title, but- thta point olearly indicatea the tendency of the courts to a very upanu cunairuuuon. "Again, it waa held - that because CASTOR I A ' Pot Infants and Children. T'It was also held that the act did not violate the same section of the con stitution because it failed to provide af firmative relief for a defendant who might prove a better title, and only al lowed a dismissal against the applicant. This point waa decided thus on the ground that a state had control over tha remedies afforded suitors in its courts and a defendant had a right to make ap plication in his own name under the Torrena act arter aeieaung nia oppon ent. "Another Interesting point waa that tha court, did not perform executive powers in making rules and instructions for the performance of the duties of registrars out tnat sucn power or the oourt waa Judicial. It would seem by thla that these rules and regulations stand upon the , same footing as any order made by a court upon its clerk. fcessoa la Beoenft ralluxe. , "Tha last point decided was one upon a theory that tne act providing that county clerka ahould be reglatrara in the several counties, created a new of fice which was neither filled by ap pointment nor by election and therefore agalnat tha requirements of the consti tution. In thla matter the court held that it did not create such new off ion but only changed or added to the dutlea of an office already existing, no mat ter by what name it might be called, and that in doing ao the legislature was entirely within Its powers. "Tne recent failure or a oomnanv an gaged in insuring titles la ample evi dence mai a uue wnicn nas been re duced to a minimum and has the back ing of the state of Oregon to carry it forward from the time the books are balanced against a certain piece of land. Is far better than the old and cumber some system. It la therefore most en couraging to aee that the Colorado court in the test case referred to has placed a liberal and reasonable construction upon its act which Is similar to that in Oregon and perhaps more so to the Washington act.
