Colorado Puts liberal Con
struction on Law in Force
in Oregon.
The provisions of the Tori-ens land
act of Colorado, recently upheld by the
unreme court of that state, are similar
to the Torrens law in Oregon, and the
decision of that court therefore becomes
of peculiar Interest here. Attorney Bob-

views in the following Interview:

liminary examination thla did not vio
late the constitution prohibiting the
taking of property without due process
of law, because the examiner's opinion
was not binding upon the court, but
only for its convenience Ire ascertain
ing the facts.
T'It was also held that the act did
not violate the same section of the con
stitution because it failed to provide af
firmative relief for a defendant who
might prove a better title, and only al
lowed a dismissal against the applicant.
This point waa decided thus on the
ground that a state had control over tha
remedies afforded suitors in its courts
and a defendant had a right to make ap
plication in his own name under the

powers in making rules and instructions
for the performance of the duties of

"Tha last point decided was one upon
a theory that tne act providing that
county clerka ahould be reglatrara in
the several counties, created a new of
fice which was neither filled by ap
pointment nor by election and therefore
agalnat tha requirements of the consti
tution. In thla matter the court held
that it did not create such new off ion
but only changed or added to the dutlea
of an office already existing, no mat
ter by what name it might be called,
and that in doing ao the legislature was
entirely within Its powers.

A ayatematlo lan of advertising the
great hotel facllltlea of the city of
Portland naa been entered upon by a
number of the hotel men who met yes
terday' afternoon at the Commercial
club parlors and effected a temporary
organisation. A committee on perma
nent organization was appointed and an
other meeting will be held at the same
filace at S o'clock next Wednesday af
ternoon. It is proposed to get out literature
telling something about the attractions
in Portland for the tourist, and giving
particulars as to tne growtn or notei
facilities in the last few years. It will
surprise Portland people to know that
Portland has practically doubled Its ho
tel accommodations since the Lewis and
Clark fair.
At yesterday's meeting Phil Metschan
Jr. was elected temporary chairman and
Dan Moore temporary secretary. The
committee on permanent organisation
is composed of Lot Q. Swetfand, rep
resenting the Perkins hotel; Dr. C W.
Cornelius, of the Hotel Cornelius, and
Mrs. Mulford of Elton Court. Tom
Richardson, manager of the Commercial
club, addressed the meeting and sug
gested pians or advertising.

tom of the river. Fills are In progress
on Belmont street and Vancouver ave
