Bee. . And be It further enacted. That the said railway shall belaid In tha center or the avenuea and streels(eacepl Ing New Jeriey avenue, and there 11 shall be laid as herein before provided ror,) as near as may be, without Interfering with or passing over the water or gas pipes, In the molt Hp proved maimer adapted ror ilreet railways, wllh rails or Ilia most approved pallerns, to be determined by the Heerelory of the Interior, laid upon an even aurface with Ibe pavement of the streets; and the space between the two tracks shall uot be leas than four reel, nor more than aix reel; and Ibe carriages shall not be less than six reel In width, the gouge lo correoond with that or the Baltimore and Ohlu railroad. And be It rurthcr eoucled, That the aald corpora tion hereby created ahall lie bound to keep said tracks, and lor the apace or two reel beyond the outer rull therenr, and nlao the apace between the tracks, at all times well paved ami In good order, without expense to the U tilled otatea or to the city of Washington. And be It farther enacted, That nothing In thll act ahall prevent the government at any Jluie, at their option, from altering the grade or olberwlae Improving all avenues and streets occupied by aald roads, or the city of WuHbliiglon rrom so altering or Improving such streets and avenues, ami the sea-erase thereof, as may be under their reipeellve au thority and control ; and In inch event It shall be the duty of said company to change their said railroad so aa lo conform to such grade and pavement. See 0. And ba It rurthcr enacted, That this act may at any time be altered, amended, or repealed by the congress or the United Slates. Sec t. And be it further enacted, That nothing In thll act ahall be so construed as to authorise said body cornorale lo lesiie any note, token, device, scrip, or other evidence of debt to be used as a currency. See. 8. And be II rurthcr enacted, That the capital atock of aald company ahall be not leu lhan two, nor more than five, hoodred thousand dollars, and that the stock shall be divided Into shares of Arty dollara each, and shall be deemed per sonal property transrerable lo auch manner aa the by-laws of aald oompany may direct. And be It further enacted, That tho said oompany ahall place ftrst-olsee care on said railways, with all Uie mod em iuiprovemenls ror the convenience and comfort or pas sengers, and shall run oars thereon during the day aa oflrn as every four mlnutea on the route from the cspltol, via the llaltlmore and Ohio railroad depot and department, to the . Circle; and on the other routes once In firieen mlnulea each way, and uulll IS o'clock at night aa often as every hair hour, aDw throughout day and night as atueh oftcner as public con venience may require. Bee. 10. And be it further enacted, Tlmt aaid company ihnll procure jurh passenger-rooms, ticket-offlcos, itnlilos, and depots At auch poinli " na, the bnslnosa of tha railroad and tlio conven ience of the public, may recjaire. And the aaid company ia hereby authorized to lay auch raila through tranaeverso or othor streets aa may lio necessary for the exclusive purpose of comioot i up; the aaid stables and depots with the niiiiii Iracki. And the laid company ia hereby author iaed to purchase or lease such lands or bnlldiiigs na may be necoasary for the passenger-rooms, ticket-offices, staples, and depots above men tioned. Bee, . And be it further enacted, That all articles of value that may be inadvertently left in any of the cars or other vehiclea of tha aaid company shall be taken to their principal depot, nnd entered In a book of record of unclaimed floods, which book shall bo open to the Inspect ion of the publio at all reasonable hours of busi ness. Boo 13. And be it fnrthor enacted, That with in live days after the passage of this act the rnr mratora named in tho first section, or a majority of them, or if any refuao or neglect to act, then ft majority of the remainder, shall cause books of anbacription to the capital stock of said company to be opened and kept open, in some cnuvcnien, nnd accessible place in the city of WiwIiiiigU.nt from nine o'clock in tho forenoon till live o'clock in the afternoon, for a period to bo flied by snid corporators, not less limn two days, unless llie whole stock ahall be sooner subscribed for nod aaid corporators shall give publio notice, by nil veriisomodt in the daily papers published in tho vjty of Washington, of the time when and llie place where aaid books shall bo opened. And be it timber enacted, That the government and direction of the alTaira of the Oompany shall be vested in Ihe board of directors, seven iu number, who shall be stockholders, and who shall hold their office for one year, and till others are duly elected and tiiialitied to take their placet aa directors. And llie aaid directors (a majority of whom, the president being one, ahall be a quorum) shall elect one of their number lo be president of the board, who shall also be proa ideut of llie company ; and they shall also choose treasurer, who shall give bonds with surety to aaid company, in such stun aa the said directors may require, for the faithful diachsrge of his trusaV In ease of a vacancy in tlx board of li rectors by the death, resignation, or otherwise, of nny director, the vacancy occasioned thereby ahall be tiled by the remaining directors. And be It further enacted, That tho directors shall have full power to ruak,o and pre scribe such by-laws, rules, and regulations as they ahall deem needful and proper, touching tha disposition aud management of the stock, prop erty, estato, and effects of the company, not con trary to the charter, or lo the lawa of the United States and the ordinances of the city of Wash ingwni Provided, That there shall be no regula tion excluding any persou from any car eu account of eiAor. And be It further enacted, That I hero ahall be an annual Meeting of the stockholders, for choice ef directors, to be holdcn at such time nd place, under such conditions, and upon such notice, as the aaid company In their by-laws may prescribe; aud aaid directors shall annually make a report in writing of their doings to Ibe slock holders. Bee. 16. And be it further enacted. That the aid company shall have at all limes Ihe free and nintrrupled use of the Todway. And bs fii further enacted, That Ba les aaid corporation shall make and complete) , their aaid railways between the eapilol and Nov nteeutb, ilreet west wilhin fottr months after tha company shall havo been organized, and the rail ways on the other routes herein described within one year after the company shall have been or ganized, then this act shall be mull and void, and no rights whatsoever shall be acquired under it. Sec. 18. And be it further enacted, I'hnt all acts and parte of acts berelofore paasod which are inconsistent with any of the provisions of this act are, for the purposes of this act, hereby repealed, so far as the same are inconsistent herewith. , . Sec. 19. And be it further enacted, That each of tho stockholders in the metropolitan Itoi road Company shall he individually liable for all me debts and liabilities of said company to an amount enuyl to the amount of stock held ny such stockholder. . Bee. 21. Aud bo It further enacted, That for each and evory violation of tho foregoing provia- . .. .." t n e..c: I . . ions, tne saia company sunn lorum aim pay sum not less than hve dollars, and not more than one hundred dollars, which may be recovered with costs of suit, on complaint of any person aggrieved, in any court of competent jurisdiction iu the district ot Columbia, nuiin action may be prosecuted in tho name of the city of Wash ington, and ono half of the penaliiea recovered shall bo for the use of the city o( Washington, and the other half for the use ul the complainant : l'rovided, however, That any partv complainant shall, before such action, lilo with the clerk of the supremo conrt of the District of Coluinbin, a bond to bo approved Dy tlio cioik oi mo saiu court, wilh at least one surety, to bo approved by said clerk, and in a pennlty of one hundred dollars, cotiditioiulo that the complainant shall well and truly anvo harmless and indemnify the snid city against the payment of nil costs and charges which shall be recovered nguinst said city by reason of the failure of Ihe complainant to pros ecute or maintain his snid complaint. And be it further enacted, That the snid railroad company shall, by tho fifteenth day of January, after the cnmpleliou of said road, nnd annually on or before thilt day thereafter, transmit to congress a full report of tho nlfuirs, bUBinoss, and comlitinn of llie mm company tor the year tcrmiiialing December ihirly-one prece ding such report, and such report shall bo signed nnd sworn to by I ho president and treasurer of tho cnuipnny, or by a minority ot the directors, ami shall specify the following items : first.
