Ifightixo kkaimiekk license. PENDLETON, Or., Dec. 21. A bitter fight against the "nenr-beer" license ordinance recently enacted by the city council is now on and bids fulr to be continued Indefinitely. While It Is yot In the city recorder's court, It will probably be carried on until the Supreme Court Is required to pass upou the constitutionality of the measure, thus making the local case one of great luterest to a num ber of other cities In the state which happen to be located la "dry" coun ties. . Following the passage of the ordi nance recently, Dee Matlock was one of a number of near-beer dispensers who applied for license to continue in business, but for the ostensible rea- son that he had confessed to the Cir cuit court charge or being guilty of selling intoxicating liquor In viola tion of tne local option law, his peti tion was denied. Almost immediate ly thereafter screens were placed on the windows of his place, notwith standing the fact that an anti-screen ordinance hud been passed severul weeks before. Friday, Matlock was arrested, and Monday Bet as the day for the open ing of his trial before Recordor Fitz gerald, and this trial is now in pro gress. Some near-beer was slezed at the time of his arrest. It is the pur pose of Matlock's attorneys to carry the case to the circuit court, and from there to the Supreme court of the ath te. His attorneys declare their client compiled with the terms of the ordinance In asking for the license and that the council could not legally deny him his request. Matlock is a nephew of W. F. Mat lock, president of the State Fair Hoard , and a nephew of Eugene's prohibition mayor. One Installment of $100,000 has a1- auy oecn levied. . ' - The levy will not be mndn until early In January, 1909, but the tota' mount here indicated, $1,275,000. is close enough to the actual amount that will be levied so that county courts may act upon It In computing their share of state taxes. Already a umber of counties have been anx iously Inquiring what the stnte tax IJ1 be. Under the existing laws, the pportlonment among tho counties 111 bo made at a fixed ratio which as been in force a number of years. u inn King tne apportionment for 909, the Stnto Hoard will bo con fronted With the problem of making n apportionment between Hood Riv er and Wasco counties without any inw proHcriuing now tne apportion ment shnll be made. The act crent- ng Hood River county contained no provision upon this subjoct. The Stnte Board passed the question up co tne Attorney-Oeiiernl and that of ficial hns advised tho Hoard to divide the Wasco county ratio between Was co and Hood River In proportion to assessed valuations. Thus tho lnw proscribing the ratio of apportion ment of stale taxes requires that Wasco county pny .0234 of the whole mount. Hut since then Hood River county hns been enrved out of Wasco. The assessed valuation of Wnsco county Is now $5,927,345 and that Hood River $2,870,280. Dividing the apportionment accordingly, Was co's new ratio will be .0158 and that Hood River .0070. Though there no law exprossly authorizing such n apportionment, the Attorney-Clen- eral expresses the opinion that this If equitable and should be adopted. The Hoard will follow his advlco. Each county can ascertain approxi mately the amount of Its shnre of the Htate taxes for 1909 by multiplying 1.275,000 ny Its rntlo. The rutin for Douglas county Is .0345. o Tills Is Worth Reading.
