MURDERER OF BEN TRACY He Has Been Returned fof Trial Lane County Murder Case to Be Heard in October Kugcno, July 28. (Special to Jour nal) Last week, after a hunt of about throe weeks. Sheriff W. W. Withers captured at Wells, Nevada, tho ninni who Is nccused of murdering and rob bing Honton Tincy, tho barkeeper, at Junction City, during the night of May ID, 11)02. At tho last term of tho circuit court, held In lOugeno last month, tho ginnd Jury cnlled upon County Judge H. It. Klncnld nnd earnestly requested that tho county use every menus possible to capture tho man who murdered and robbed Honton Tracy nt Junction City, and should nuthorl.o tho necessary ex-i ponse. In addition to their verbal rec ommendation they filed with the county Judge, In order to Justify tho expenso of making a thorough senrch In other Btntos, the following written special repert: In the eh cult court of tho stnto of Oregon, for I.nno county. Special recommendation of grand Jury to county court of Lane ceunty: Tho grand Jury finds that Honton Tracy wns shot down In cold blood In Junction City. I.nno county, Oregon, during the night of May 1!). 1002. After healing tho evidence wo hnvo concluded and say that the killing of Tracy was a commercial transaction; a brutal, calculated murder of n mnn for the money in his possession. The criminal has OHtapod from this county nnd state, but wo believe, from the evidence before us, that ho can yet he captured and brought to Jus tice. That we believe that I.nno county should assist Its olllecrs In tho pur suit of the fugitive beyond this stnto, and we recommend that tho county court of Lane county defray tho ex penses of the sheriff In searching for the said muiduror within other states. Dated at lOugeno, I.nno county, Ore gon, this 18th day of Juno, A. 1).. 1902. 10. P. Kedford, foreman of ginnd Jury: Henry Gates, James A. Stevens, S. N. Sdirlmpf. 11. J. Streeter, 0. N. Mc Lean, H. G Veutch. giaud Jurors. This report wns submitted to Coun ty Commissioners Kdwards and Hill, and, after due consideration, the county court authorized Shoilff W. W Withers to go nt the expense of tho county, nnd miike a thorough soardi as long nnd n fur ns he could find any trace of tho murderer, until ho sue ceeded in capturing him, or should consldor his enpturo Improbable. After n long nud tedious c-base the sheriff succeeded In running the rascal down at a Utile station on the Central I 'a clllc lallroad in Nevada. He then had to get u requisition from the governor of Nevada before he could bring the prisonor to Oregon, which detained him n few days longer. Of all the sheriff Lane county has ever bad Withers hns been the mot HucceMHful In capturing and holding prisoners. In this particular case he has nmm pllshod what, to nuxt people, seemed impossible.
