Tho weed Hhould bo exterminated before tho seed has rlponad. The present law In regard to tho ex tirpation of thistles was passed at tho legislative session of 1899, nnd 1b very stringent In ItH provisions and severe In Its penalties. Tho statute covers Cunudlan, Hussion and ChlneHC this tles. Section 1 of the act prescribes that It Khali bo tho duty of the road supervisor of each road district to as certain If there aro any such thistles within his district, and to notify tho county Judge of the fact, and nlso the owner of the land If the owner, or occupants of tho laud upon which tho thistles lire found, shall fall or refuse to destroy tho weeds, nftor being prop oily notified, the road supervisor is authorized to employ all necessary help, and proceed to the extirpation of the thistles, and tho cost of per forming the work shall operate as a Hen against tho property, prior to nil other Hens, except that of taxes. If the Hen Is not discharged within six months, tho district attorney Is dl lected to bring suit In the name of the county against the property, nnd duly foreclose tho lion, and tho proporty shall be sold under execution for the satisfaction of nil claims resulting f i om the proceeding. The rood com missioner shall receive a pur diem of $.1 per day for the work, and bills for performing tho work of extirpation shall be paid by the county court ten days after the hill Is presented, If no valid objections are offered theieto. Section R rends us follews: "If any person, persons or corpora tion owning, possessing or having care or chat go of any land or Innds Improved or unlmpioved. Inclosed or iiuliiclosed, In the state, shall, know ingly, permit or suffer any Russian thistle, Cnnadian thistle or Chinese thistle to grow up thereon, and suffer the same to stand until ItH bloom fnllH or Its seeds begin to form, such per son, persoiiH or corporation shall he guilty of a misdemeanor, nnd, upon conviction thereof, shall, for the first offense, be lined not less than $10. and for the second, nnd each subsequent offense, not less than $2G, and linos to bo recovered, with costs, in nn action to be brought In the mime of the coun ty where the offense Ih coiuinlttod." Section 7 deals with the road super visor. It Is as follews: "If any rond supervisor of any load district in the state carelessly or willingly neglect any of the duties Imposed by this act, or violate any of the duties imposed by this act, or violates any of the pro visions thereof, he shnll he deemed guilty of a misdemeanor, and, upon conviction thereof, shall bo fined not lees than $fU nor more than $150." "Section 8. It shall be the duty of .ill municipal corporations in this state to provide for the extermination of said Hiisslan thistle, Canada thistle or Chinese thistle, within the limits of such corporation, or upon the va cant lands of said corporation, ami any city or town lucoriiorated within the state neglecting, or infusing to comply with the provisions of this net. shall be liable to a forfeiture to the county in which said municipal coriHiratlou Is situated of a sum not less than $60, nor more than $500, to be recovered against such iiiuuIcIikU coriHiratlou In a suit maintained by the county In which said municipal coriHiratlou Is altuated." Anson, appellant; appeal from from Marlon county; O. H. ilurnett, Judge; opinion by Justice Hcan; affirmed. This was an action to recover .v G82.18 in money, that was alleged to havo been converted by Anson to his own use, while acting as manager of the corp6rntlon. In the lower court Judgment for the plaintiff corporation was rendered for $3601.08. The prin cipal question decided Is whether one can recover money thnt has ueen con verted without definitely establishing Its identity, anil descrimng me con verted funds. On this question, the court finds thnt, fiom the naturo of things, It wns an Impossibility for the plaintiff corporation to describe with reasonable certainty the Identlcnl money alleged to have been converted iiv ilin iipfniiiinnt. anil hoius tnni u was unnecessary to supply the Identi fication. "The conversion." says Jus tice Hean, "consisted of distinct acts done by virtue of the confidential re lations existing between the plaintiff nnd tho defendant.
