This proposed action of the secretary of state Is of the highest Importance, and makes it ncceswry that the le. "The secretary Is further sustained in his decision by subdivision 7, of section 2209, of Hill's code, which pro Tide, amomr other duties of the sec retary of state, that, be shall examine and determine the claims of all per sons against the state, in cases where provision for the payment thereof have been made by law, and to Indorse upon the me the amount due and allowed thereon and from what fund the same Is to be .paid, and draw a warrant upon the treaury for the sine. That the secre tary of state has the authority and it is his duty to decide upon which claims shall be audited and allowed, and for which he shall draw warrants, is evident from section 2, of article 6, of the secretary of state shall be by virtue of hi office, auditor of public accounts, and shall perform such other duties as shall lie assigned him by law. "It will be seen by the foregoing quotations from the constitutio n, the statutes and the opinion of the su preme court, that the secretary of state is not authorized to Issue war rants until after money has been ap propriated for their payment.
