whole situation is set forth In the fol
lowing statement, prepared In the

"The present legislature has appro
prlaUd no money to pay the current
expenses of running the state govern,
ment for the biennial term, commenc
ing January 1, 1807, and ending De
cember 31, 1608. The secretary of
state, II. It. Klncald, has decided that

treasurer for the payment of the claims
of any of tho members of the legisla
ture for their saliiry and mileage, fpr
the claims of other employes of tho
legislature for services rendered; ror
the claims of merchants and other
persons for Hupplles furnished for the
legislature; for the claims of officers
and employes of tho different state In
(dilutions for salcrlcs; for the claims
of merchant and others ror supplies
furnished to such institutions, nor
for any person or institution, except
where- there is a statute making an

This section says that 'no money
shall be drawn from 'he treasury but
pursuance of appropriations made by
law.' That there have no approbrla
tlon by law for the carrent and other
expenses of the biennial period, corn
menclntr January 1, 1897, and ending
I December 3J, JgJ5, no one will at
tempt to deny.
"The secretary Is further sustained
in his decision by subdivision 7, of
section 2209, of Hill's code, which pro

provision for the payment thereof

virtue of hi office, auditor of public
accounts, and shall perform such other
duties as shall lie assigned him by
law.
"It will be seen by the foregoing
quotations from the constitutio n, the
statutes and the opinion of the su
preme court, that the secretary of
state is not authorized to Issue war
rants until after money has been ap
propriated for their payment. When
an appropriation has been made he Is
required to I .sue warranto to pay legal
account whether there be any money
