Federal Power Commission's Timid' Approach Rapped WASHINGTON' l'PI Federal Power Commissioner Howard Morgan said Wednesday that there were occasions when the commis sion refused to investigate a sit uation because it felt it "would disturb industry." Morgan, who had differed with his colleagues and had asked President Kennedy not to re appoint him in June, discussed the workings of the commission in a sometimes heated hearing be fore a House commerce investigat ing subcommittee. Rep. John B. Bennett, R-Mivh., questioned Morgan sharply on a letter the commissioner wrote to Kennedy Jan. 23. He asked Mor ga'n to give an example of his phrase: "Ordinary men yield too quickly to the present day urge toward conformity, timid'ly end personal security." Morgan re plied: "When in a commission meet ing the statement is made that we must not investigate a situa tion because it could disturb in dustry. . .and that statement is acted upon, I would say this is an example of what I was talk ing about." Cites Some Cases Morgan said such a policy was followed in cases Involving the Idaho Power Co. and the Pacific intertie. The Pacific intertie deals with the tie-in of power lines to .carry surplus Pacific Northwest power to California markets. Federal construction of such an intertie has been recommended by the In terior Department while private power companies want to build such a connecting power line themselves. Morgan, under questioning by Bennett and Chairman Oren Har ris, D-Ark., agreed that the "de terioration" in the administration r.f regulatory laws since World War H had been "halted" and that a visible improvement was now. clear. Bennett accused Morgan of tell ing Kennedy that other members of the commission were "a hunch of low-level l . .timid peoplS" and Wei's "doing a danged poor job." Morgan denied this and repeat edly refused to comment on other members. "This witness is being evasive," Bennett said. "I don't think he's being frank with us. I don't think Civil Defense Draws Support WASHINGTON (UPI) - Rep. Robert B. Duncan, D-Ore., has urged the Oregon Legislature to strengthen the civil defense pro gram rather than abandon it. The plea was marie in a letter to House Speaker Clarence Bar ton and released by Duncan's of fice. . Duncan, former House speaker. said ;,"perfect protection" was not possible but that efforts should be made to provide as much protec tion against nuclear war as pos sible. he's being honest. Bennett also charged that Mor gan was "giving the committee tne same kind of gobbledygook he gave the President." Praises Dissenting Opinions But .Rep. John E. Moss. D- Calif., said .Moroan's Hissnniinu rr opinions snowed a ' sense of great vigor, clarity and locic." wuestioning by subcommittee members was expected to bring into the open a dispute with Com mission Chairman Joseph Swidler, who will testify Thursday. Harris said the committee's in terest had been heightened by "critical general remarks" in the letter by Morgan to the President in which the commissioner made highly critical remarks about the FPC administrative process. He said his reasons for wishing to leave the commission were "clearly visible" in his lone dis sents to commission decisions. In his sharply worded dissents. Morgan made it clear that he felt the majority was favoring private industry over the public interest. Cites Hells Canyon Pressed for the type FPC de cisions he had criticized, Morgan cited an order authorizing the issuance of $30 million in promis sory notes by the Idaho Power Company to finance construction of the Little Hell's Canyon Dam on the Snake River. The former Oregon public utility chief and state Democratic chairman said the order had ap peared to be non-controversial and a "run-of-the-mill" decision b u t that it had been issued without proper investigation. "Tile Idaho Power Company now is selling 20 per cent of capacity at below the cost of production of electricity,'1 he said. As a result, he said, a study should have been made whether the additional capacity from the company's proposed third dam might be "a threat to the com pany in view of its soundness." Morgan's dissent said the dam proposal should have been inves tigated because it might ag gravate the company s problem in selling surplus capacity. He suggested that the Bonne ville Power Administration might extend its marketing area into the area served by the private companies. "If the Bonneville Power Ad ministration extends its market-; ing area," he said, "no one can predict when. If ever. Idaho Pow er can market tlic surplus power."
