Indians Fight McNary Dam LAPWAI, Idaho, July 24 iPt Al ready authorized by Nez Perce In dian tribesmen to seek an injunc tion hulling construction of McNary dam, tribal Attorney Kenneth R. L. Simmons of Billings, Mont., will meet Friday at Toppeniah to con sider similar action by the Yaklmaa. The Nez Perce allege McNary dam construction at Umatilla, Ore., vio lates an 18&& treaty entered into by themselves and the Yaklmaa with the federal government. Simmons said congressional au thorization does not provide for condemnation or compensation for Indian property affected by the dam. The construction also "Jeop ardizes" Nez Per&e fishing rights which deportment of Interior esti mates have valued at between $15, 000.000 and 120.000.000, he said. .
