Minear said the commu nism publication - designed as a teaching aid to be dis tributed only to teachers -was developed "with the feel aware of the dangers of the communist system by explain ing to them what communism really is. They feel certain that edu cation is the only adequate defense. But they want to be very sure the program they pro pose is the right one. The law gives to sub-contractors, laborers and persons furnishing materials a lien on the property on which the work Is done or for which the materials arc furnished to secure the payments of their accounts. Such liens are call ed "mechanic's liens." If an owner of property hires his own labor or buys his own material, it Is easy for him to sec that the bills are paid. However, If he em ploys a contractor, then the problem is more difficult be cause the contractor will of ten hire sun-contractors (plumbers, painters, plaster ers, etc.) and buy materials. These sub contractors and materialmen have the riijht to a lien on the property If they arc not paid by the con tractor. To obtain his lien a sub contractor or materialman must give written notice to the property owner that he has furnished labor or ma terial on the property and that he will claim a lien against such real estate in the event he is not paid by the contractor. Many sub-con-tractors and materialmen give such notices as a routine prac tice to preserve their lien rights. Then, if upun completion of the work he is not paid by the contractor, the sub contractor or materialman will file a lien claim. If the lien is not satisfied (the amount due paid) by the con tractor or the property own er, a lawsuit may be brought lo foreclose the mechanics lien - much In the same man ner as the foreclosure of a mortgage. Obtain Waivers How can a properly owner protect himself against ihe tiling of mechanic's liens against his properly? The simplest way is lo deal witli a contractor who is reliable and responsible. Secondly, he can require the contractor lo obtain lien waivers from all Ihe sub contractors and ma terialmen prior to making fi nal payment on the contract price noon completion. Where a property is being purchased, whether it be a new house or an old one, the purchaser should Inquire to sec whether there is any pos sibility of mechanic's liens being filed against it. To pro tect himself against such se cret liens that have yet to be filed, the purchaser may require that the seller agree to satisfy any mechanic's liens arising from work done dur ing the seller's ownership of Hie property. If the house is a new one. the purchase may request the seller to obtain lien waivers from the con tractor, subcontractors .uvt materialmen. (Oregon lawyers oflcr this column as a public service.
