f Requests Refused By Commission At Thursday Meet Two requests for variances from the city's minimum building standards were turned down Thursday night by the Medford planning com mission. The planners refused a re quest from Tom Whittle for a minimum area requirement variance for property at Keene way and Highland dr, Also refused was George Lov- enborg's request for a setback variance to permit erection of a carport alongside his house at 618 Dakota st. about a foot from the side lot line AUan Jferry, commission member, stated with respect to Whittle's request that was evident considerable property swapping had been undertaken in apparent ef forts "to. circumvent the city zoning code and building reg ulations." He did not specif ically relate these effort to Whittle himself. Request Denied Lovenborg's request was denied because, as explained by Jack Edson, another com mission member' the car fa cility could be provided else where on the property with out a variance being neces sary. A hearing on the proposed rezoning of part of Harold Fair's Valley Center Trailer court property on North Pa cific highway from limited light industrial to light indus trial the zone required un der the present zoning ordi nance for trailer courts was continued pending action on the trailer court ordinance now under study. This ordinance, as drafted, would permit trailer courts meeting certain standards to be zoned multiple family. Tract Annexation Annexation of a tract be longing to Dan Patch east of Ellen ave. and Marilee st. in the Berrydale area was rec ommended by the planners to the city council. The commission called for a hearing at the August meet ing on the proposed rezoning of property on Barnett rd. west of Bear creek from com mercial to light industrial to permit a veterinary hospital. The request was reportedly made by Dr. James W. Bay liss, whose Siskiyou Veterin ary hospital is at that loca tion. The planners also called for a general land use study of the Earhart tract, in which the hospital is situated. Another hearing called last night for the next meeting concerns a requested change from multiple family to spe cial parking zoning for prop erty at 412 South Oakdale ave. This change, it is under stood, would accomodate shoppers at the nearby Oak dale Big Y market, 401 South Oakdale ave. Street Vacation The planners denied a re quested vacation of a short bit of street at the edge of the Eastwood subdivision just east of the present terminus of 'Plane Wreckage' Just Odd Formation Detroit, Ore. (DPD Marion county sheriffs deputies said today that what was thought to be plane wreckage appear ed to be just an old formation of logs, bleached by the sun and snow. Deputies went to Elk lake, 14 miles north of here Thurs day to check out a report that light plane wreckage had been found. They pointed out to the property owner asking the change, however, that should he relocate a water main and storm sewer along the dedicated street and ar range for an exchange of property to obtain an adja cent right of way for the street, the request might be more favorably considered. The proposed dedication of Hoover lane by Mr. and Mrs A. V. Hardy was referred to City Attorney Joel B. Reeder for further study of legal con siderations. Marx Brother . Tells of Wagers With Syndicate : Terre Haute, Ind.-flJPD-For- mer comedian Zeppo Marx and three wealthy business men testified Thursday they bet thousands of dollars with an alleged gambling syndicate during the 1957 football sea son. 1 Marx, the one-time "fourth brother" of the Marx Broth ers comedy team, said he wa gered "10,000 - it might have been more" by calling Terre Haute from Las Vegas, Nev., or from his Palm Springs, Calif., home. Major Link The testimony forged a ma jor link in the government's case against eight alleged gamblers charged with evad ing $325,000-in federal excise taxes on gambling income. More than 20 men, whom the government said took the Fifth Amendment before an Indianapolis Grand Jury last summer, were on tap for to day's session in federal court. The Grand Jury indicted the eight on tax evasion charges. Julius Gaines, a Miami con struction executive, ' Hugh B. Key, Norman, Okla., oil exec utive, and John H. Judd, of a Bakersfield, Calif., produce firm, testified they placed bets with the syndicate, which operated ; here for 10 weeks before it was raided by U. S. Treasury agents. Contacts Identified The three businessmen each identified one or more of the defendants as their contacts and Marx said he had "met two of the gentlemen - Mr. Irwin Gordon and Mr. Phil lip "Flippy" Share.", . ; ; When Federal Judge Cale Holber asked Marx how -he happened to place his bets in Tprre Haute, Marx answered. Judge, any kindergarten kid in Las Vegas can give you the name of a bookmaker." Judd said he made a $2,000 bet with the syndicate on the 1958 Oregon-Ohio State Rose Bowl game. Birkenfeld Man Accident Victim Vernonia - (UPD - William Lee Barlow, 20, was electro cuted Thursday while he aid ed in a truck loading opera tion at the Mist Lumber Co. near here, according to Dep uty Columbia County Coroner Jim Fuiten. Barlow was a son of Mr. and Mrs. Leon F. Barlow of Birkenfeld. A driver for Lawrence Jep son & Sons, Barlow was hold ing a guide chain pn a trailer as it was being loaded on a truck by a mobile loader when the arm of the loader touched a high voltage line. Govs. Edmund G. Brown of California, Mark Hatfield of Oregon and Albert D. Rosel lini of Washington met .Thurs day to start talks toward Cali fornia purchase of a large block of Bonneville power from the Northwest. Task Fore Planned The - governors agreed on these points: -That a task force commit tee representing the governors would join with the Bonne ville Power Administration on studies of the proposed power inter-tie. . -Independent of the Bonne ville study, the committee would continue to search the legal aspects of the proposal, but California had agreed not to claim the right of a pre ference customer if the power ever is needed in the prime service area. -To assure that the studies gives consideration to all serv ice areas involved, the gover nors also agreed to invite 'the governors of Idaho and Mon tana to join in the studies. Wanlc Low-Cost Power Brown appointed Ralph Brodie, his water adviser, as his representative on the task force committee. Brodie said California's major interest in Northwest surplus power is .to get low cost power from the Bonne- villel Administration for, use in pumping water through California's proposed aque duct system to Southern Cali fornia. Brown Thursday signed a bill calling for a $1,750,000, 000 bond issue on the 1960 election ballot to build Oro ville Dam and the aqueduct system.. Signs Appropriation The governor also signed into law a $70,000 appropria tion for California's part inn the Bonneville power study. Brodie explained that the proposal is for California to buy a large block of what is called "dump power" that which is wasted because there are no customers.' He said he felt California could buy this power cheaper than it could produce it. It mainly would go for the water pumping, but it also would be available to public and pri vate power companies in Cali fornia. ' Mack-Whifeslde Jury Undecided Washington - (LTD - The government's conspiracy case against Richard A. Mack and Thurman A. Whiteside ended today in a hung jury. This means the complicated cise will have to be tried over. Presiding Judge Burnita S. Matthews dismissed the jurors after Foreman Robert E. Bur ner sent her a note saying that 11 members had agreed on a verdict but that they could not change the stand of the 12th juror. Mack, a former federal communications commis sioner, , and, Whiteside, a wealthy Miami attorney, were charged with plotting in the award of TV channel 10 in Miami. , Tuna Found Off Cape Blanco Light Portland (DPD The tuna troller Flicker has reported finding tuna some 45 to 50 miles off the Cape Blanco light. The Flicker is under charter to the Oregon Fish Commission for an albacore tuna hunting expedition. The Fish' Commission team on the boat, Bob Ayers and Bob Rohland, said they found 61 to 62 degree waters in the area and caught tuna in the vicinity. The Zebra, commercial fishing boat out of Coos Bay, has sailed for the area and is being joined by other com mercial boats. Last year, a good year for tuna, saw some 10xi million pounds of albacore tuna land ed at Astoria and other coast ports. ' GOING OVERBOARD Montpelier, Va- (DPD -When a controversial bill regarding the regulation of motorboats appeared on the legislative calendar, someone had attach ed a note to it reading: "The pending question, is shall the measure sink or swim." Cyprus, the strife-torn Brit ish colony in the Mediterran ean, is an island of 3,570 square miles. Petitions Presented To Change Zone In Near East Side . (Continued from Page 1) Among those presenting pe titions by neighborhood resi dents supporting the rezoning along Crater Lake ave. last night was Dr. William Thomp son, John Williams, Mrs. Scott Wickersham and J: S. Good win. The petitions on a pre liminary count showed 101 signatures. Others speaking in favor of the change included Mrs. Bert Pree, representing Mrs. Phyl lis Smith who owns property at 201 Crater Lake ave., Mrs, Rose Padgett, 40 Crater Lake ave., and Walter Higgins. Among those opposing it were several residents of adjacent Minnesota a v e. Aubrey Morris, James Rowan and Dr. Fred Lorish and Fifteen Drivers Get Licenses Suspended Salem The department of motor vehicles has released names of 471 drivers whose licenses were ordered sus pended during the period be ginning June 29, and ending July 3. Length of suspension varies, depending on charges in- v o 1 v e d,- recommendation of court, discretionary action by the' department or require ments of Oregon law. The de partment said some of the li censes involving financial re sponsibility and court recom mendations may have been re-instated after suspension was ordered. The department warned dri vers that the penalty for dri ving while suspended is a jail sentence of no less than two days and up to six months, and there may be imposed a fine up to $500. Under licensing procedures, this will also re sult in an additional year of suspension. The burden " of arguments favoring the zone change was that the neighborhood was currently "declining" and in cluded several non-conforming uses normally relegated to multiple family zones. The re zoning, it was argued," would encourag e construction of new apartments and , profes sional offices and thus im prove the street. Crater Lake ave.'s charcter as an arterial street, less suitable for resi dential use, was also pointed out. Resent Statement "I resent the fact that they call it a declining zone," Dr. Lorish rttorted. To which Dr. Thompson replied, "No one said Minnesota ave. is a de clining . neighborhood." Just Crater Lake ave. was meant, it appeared. - " "The worst bit of declining I've seen," Rowan stated, "is since Dr. t Thompson bought the property" at Crater Lake and Reddy ave. He referred specifically to the condition of the lawn. . Mrs. Padgett defended Dr. Thompson by saying that the property ' had declined well before he entered the picture. A previous individual re quest by Dr. Thompson that his property at Crater Lake and Reddy be rezoned to mul tiple family to permit erecting a clinic was turned down a few .months ago as spot zoning. Encourage Deterioration . Arguments against the re zoning generally followed the lines that it would only en courage deterioration of exist ing, structures into rooming houses and other such uses, that it would be only the first step in a march toward event ual commercial zoning, -and that it would isolate the area to the west, including .Minne sota ave., from other single family zones. Rowan urged the commis sion to develop a long-range plan for the whole area, in stead of acting on single re quests street-by-street. Man Arrested in Sinking of Vessel Anchorage, Alaska - (DPD - John Solnordal, 28, was ar rested Thursday at Dilling ham and charged with willful ly and knowingly permitting the destruction of his $80,000 fishing vessel Cape Doug las" in Puget Sound last De cember. Solnordal was to be flown to Anchorage for arraign ment. ' The vessel was raised July 7 and her hull found intact. However, investigators said valves in the bilges were f ourid . open, which would have allowed water to enter the hull. Youth Rescued At Ocean Beach Rockaway-(DPD-Gregg Vita- ich, 16, of Tujunga, Calif., was pulled from the surf Thursday evening here by members of the Rockaway Volunteer Fire Department and beach residents. The youth, vacationing here with his father and mother, swam nearly 200 yards off the beach, but was unable to swim back through the surf. The International Trade Fair being held in connection with the Exposition has been attracting lively' attention by Exposition visitors. A survey has shown. Cen tennial officials said, that -a large percentage of the vis itors to the Exposition grounds visit both the Expo sition events and the Trade Fair exhibits. Long retreated to his tin-roofed farm home in the north Louisiana hills early today, miles from the nearest psychiatrist. Long pulled in 42 hours after roaring away from Baton Rouge, the state capital, Thursday night with sirens screaming. He went intcj the house on his "little pea patch" and immediately went to bed. Politicians who made the trip with him said he made "six or seven" stops along the way, but wouldn't say why or where. He made the trip in a new Cadillac limousine, convoyed by state police cars. Begins, Vacation Long was reported ready to begin his vacation today, by flying into Texas. For the first, time since Long got out of a mental hos pital June 26, he made a trip without a psychiatrist at his elbow. As he left the mansion in Baton Rouge for the first time in 48 hours, he threw up his arms to hide his face. Wants To Adopt Boy And after leaving Austin, the sources said, Long plan ned to go to Texas City, Tex., to see David Rankin, 14, the boy he met in the Galveston hospital and wants to adopt. Rankin spent most of the week with Long. He left the mansion for home Thursday morning. Reports concerning Long's condition were gloomy, al though his aides attempted to present a rosy picture.- His executive secretary, A. A.
