Council Discusses
Possible Sewer for
Eastover Terrace
Possible installation of a
sanitary sewer for Eastover
terrace despite present objec
tions to the cost from a ma
jority of property owners was
discussed at last night's city
council meeting.
City Manager Robert A.
Duff told the council that the
sanitation situation on East
over terrace is "serious" with
raw sewage running in the
ditches.
The council March 19 ap
proved awarding a contract
for the sewer to R. A. Heintz
Construction company, sub
ject to the property owners'
concurrence. Duff reported
last night that a majority of
the 11 property owners in
volved objected. The Heintz
bid, while the lowest, was con
siderably above the engineer's
estimate.
Object To Bid
The property owners while
anxious for a sewer, had ob
jected previously to accepting
an excessive low bid on a dif
ferent set of plans.
Duff said the estimated
cost per lot with the Heintz
bid would be $1,077. The unit
cost from the low bid on the
earlier plans would have been
about $1,243, he said.
He told the councilmen that
since no other alternatives
were possible, they could
authorize signing the contract

and Utilities.
One was Senate bill 107
which would have provided
that no person could be ap
pointed to the Port of Port
land Commission if he owned
or was employed in any
transportation, shipping, stor
age or towing business.
The other bill had the same
provisions but applied to all
port districts in the state.
The Senate passed a bill to
permit the State Highway
Department to appoint a di
rector of recreation to study
and develop recreation facili
ties in Oregon.
A bill to permit the use of
Nalline? an opium derivitive,
for treatment of narcotics ad
dicta was approved.

The councilmen, realizing
this would be as Councilman
Donald Hansen, Ward II, put
it "a very weighty step,"
agreed to inspect the site and
meet with the property own
ers before making a decision.
Duff was to arrange the visit
this week end if possible.
Carl Brophy, Medford attor
ney speaking in behalf of one
property owner, voiced an ob
jection to assessing Eastover
terrace residents on the basis
of lots rather than dwellings.
Duff replied that the council
could determine the method
of assessment as it saw fit in
relation to benefit. The basis,
he explained, could be deter
mined at a later date.
In other action, the council
awarded contracts to low bid
ders for the paving of East
Jackson st. from Bear creek
to GC-nessee st. and for the
paving and installation of
curbs and gutters for Colum
bus ave. from West Jackson
st. to McAndrews rd.
The East Jackson st. con
tract went to Tru-Mix Con
crete company, which bid
$25,254.85. For Columbus
ave., Rogue River Paving com
pany was awarded the paving
contract at $3,465 and Pet
rehn and Purdy is to install
the curbs and gutters on a bid
of $2,603.
Approve Recommendation
The councilmen approved
Duff's recommendation that
the sanitary sewer for Spen
cer ave. and a stretch of South
Riverside ave. down to Stew
art ave. be financed by the
usual method of assessing
benefiting properties on a
combined acreage and front
footage basis.
The assessment rates for the
$27,175 project, as reported to
the council last night, would
be $135 per acre and $2.35 per
front foot.
Two property acquisitions,
one of a $650 lot from William
A. Hoskins for the projection
of 10th st. and the other a
site for the Berrydale sewer
pumping station to be pur
chased from John R. Creel for
$1,250, gained council ap
proval.
The council authorized and
approved plans and specifica
tions for construction, of a
storm sewer system for Keene
Way dr. from Oregon ave. to
Stratford way and for Oregon
ave. from Keene Way to Berk
eley way. Cost of the project
is estimated at $5,000.
Also approved were plans
and specifications for paving
streets and installing sanitary
sewers in the Blossom Hill
Terrace Unit No. 1 subdi
vision, situated at Crater Lake
ave. and Buckshot Hill rd.

Street from Mary Street to Mc
Andrews Street and to assess the
cost of said water main on the
property fronting on said street (s)
in proportion to the frontage of
said pro-Deity.
SECTION 2. That the City Coun
cil shall meet in the Council Cham
bers of the City Hall of said city
at 7:30 o clock J.M. on the ISth day
of April, 1959, at which time and
place all protests against the lay
ing of said water main and the
assessment of the cost thereof on
the property fronting on said street
(s) shall be heard, and the City
Recorder is hereby directed to
cause tms Resolution to be pub
lished once '.n a daily newspaper,
printed, published and of general
circulation in the said city of
Medford, not less than ten days or
more than twenty days before the
date of said meeting and a copy
of this Resolution to be posted for
a period of ten days prior to said
meeting in five public and con
spicuous places in the said city.
SECTION 3. That warrants for
the costs of the aforementioned im
provement shall bear interest at
4 per annum and shall constitute
General obligations of the City of
Medford, and said warrants shall
be issued pursuant to, and on the
terms and conditions set forth in,
ORS 287.502 to 287.510, inclusive.

sewer to serve properties on South
Riverside Avenue from Spencer
Street to Stewart Avenue in the
City of Medford, Oregon, and for
the assessment of the cost thereof
on adjacent property; providing for
a meeting of the Council to con
sider protests against said im
provement and providing for the
serving of the owners of adjacent
property with notice thereof by
the Recorder.
THE CITY OF MEDFORD DOTH
ORDAIN AS FOLLOWS:
Section 1. That it is the inten
tion of the council to cause the
construction of a sanitary sewer to
serve properties on South River
side Avenue from Spencer Street to
Stewart Avenue in accordance
with the hereby adopted and iden
tified plans and specifications on
file in the office of the City Man
ager, at the City Hall, Medford,
Oregon, to which plans and speci
fications reference is herebv made
for details and estimated costs
thereof, and to assess upon each
lot or part thereof, adjacent to and

proportionate share of the cost of
said improvement as provided by
the Charter of the City of Med

LANDSLIDE KILLS SIX

said today that six
persons were killed when a
landslide crushed a farm
house Thursday. The slide,
triggered by heavy rains in
recent days, wiped out a
whole family.
Neuberger Urges
Rebate of Federal
Taxes To States
Salem-ttJPD-Federal tax re
funds to states large and small
throughout the nation have
been advocated by Sen. Rich
ard L. Neuberger (D-Ore.) at a
news conference here.
Such tax rebates, he said,
were necessary to relieve the
fiscal problems which he said
virtually every state in the
union is now facing.
His idea of the federal gov
ernment rebates, he explained,
would be based on the amount
of federal taxes collected in
each state plus an equaliza
tion feature that would take
into account the money de
rived in the large manufac
turing centers of the nation.
Tax Hike a Must
Neubeger said federal taxes
must be increased to meet the
obligations of the free world.
But he added that many states
cannot survive unless they are
given some financial aid from
the federal government.
"I am not too familiar with
the fiscal problems facing the
Oregon Legislature," he said,
"but it would be my guess that
they are shaking every piggy
bank they can get hold of to
find the necessary money to
carry on state service," he
said.
The Oregon senator said he
was advocating renenactment
of the federal excise tax. He
said that only a few weeks
ago the military draft was ex
tended for four years and that
profit of munition makers was
higher than it was during the
Korean conflict. They now
escape the tax.
Postal Rates Mentioned
The Oregon senator also
said he would introduce a bill
in Congress to cut the deple
tion allowance to oil compan
ies from its present 27 per
cent rate to 15 per cent.
"There are no depletion al
lowances given teachers who
lose their eyesight or doctors
who become ill or any other
category of workers who be
come disabled," he said.
He also would allow the
Postal Department to set its
own mail rates and he advo
cated -an increase in the fed
eral gas tax from its present
3 cents a gallon to 4A cents.
