Shep pard's pleas for a new trial be cause the claim of new evidence was "still in the realm of theory." The 31-year-old osteopath, in his second bid for a new trial since he was convicted of his wife's murder, had argued that; evidence discovered since his conviction showed someone else committed the crime. The state, arguing against the appeal, said the defense case was "opinions, speculations and conjectures." Judge Blythin's 16-page re fusal to grant the new trial said defense attorneys had failed to show that evidence submitted for his study was not available at the time the trial started last fall.
