The continued Illness of Ralph Moody, assistant attorney-general, who conducted the prosecution In the Banks murder trial, and the bal lot theft cases. Is given as reason for the change. Attorney Moody has been 111 for several months, and recovery has been slow. ' The state's reply brief must be In the hands of the state supreme court by March 10, when a date for argu ment will be set. Attorney Ltljeqvlst will be assisted In the preparation of the state brief by District Attorney George A. Codding. A 600-page transcript of the testimony Jn the murder trial was received this morn ing. The defense brief, filed a month ago, lists as grounds for appeal, al leged misconduct by Jury bailiffs, statements of the prosecutor. In his closing address, characterizing Banks "as a moral coward hiding behind the skirts of a woman," and claims 11 errors at law by the trial Judge. Attorney Llljeqvist is well known In this county. He was named a special prosecutor In the Bank of Jackson ville failure trials, the Klan night Tiding trials and In liquor prosecu tions. It la forecast that by mid-summer a decision by the high court will be made. In the ordinary course of busl. cess, It takes from six weeks to three months for a finding to be reached. The transcript of the evidence In the case of Gordon L. Schermerhorn, former sheriff, under conviction of ballot theft, was completed and turned over to his counsel last Satur day. Monday, March 0. has been set by Circuit Judge George T. Sklpworth of Eugene as the final date, for the . filing of bill of exceptions. In Schermerhorn 'a appeal to the supreme court. Ha haa been granted three extensions of tune. The transcript is voluminous and coat 408 to pre pare. Schermerborn Is at liberty on 17500 bonds, pending appeal, and his la the last of the vote-stealing cases. In all the others, the defendants are serving prison terms, enjoying pa roles, or were dismissed. Tom L. Brecheen, former Ashland resident, "star boarder" at the county Jail during the Banks-Fehl turmoil, who plead guilty to ballot theft and received an 18-montha sentence will be eligible to parole In April, when he will have served half his sentence. J. Arthur LaDteu, former business manager for L. A. Banks' newspaper, Earl H. Fehl and Walter J. Jones, leaders In the ballot crime, and all serving four-year sentences at Salem, will not be eligible to parole until they have served 18 months, from the date of entry last August. L. Alvln Tollefson, former cashier of the Central Point State bank, serv ing two and one-half years for con fessed perpetration of a bank robbery hoax, will be eligible for parole in May. TO AID JUBILEE E 10 I Assurances of complete co-operation and participation In Oregon's Diamond Jubilee celebration In Med ford next June, 3 to 9, was received today by the Chamber of Commerce from T. L. Stanley, general manager of Vie Shasta-Cascade Wonderland association. The Wonderland association has completed preliminary arrangements with the Redwood Empire association for the running of a Joint caravan to arrive in Medford during the cele bration. The caravan of the former will start from San Francisco, com ing up the Pacific highway, while the latter will proceed north from the Golden Gate city on the Redwood highway. The caravans will be com posed of several hundred people. This evening at 8:30 the Fpworth League of the First Methodist Epis copal church Is holding Its annual George Washington banquet. This banquet haa been an annual event for the past twenty or more years. All Epworth League members, their parents and friends, especially form er members of the League, have been Invited to attend. An entertaining program has been arranged under the direction of Olaf Severwm Jr.. and his committee. Rev. Joseph Knotts will act as toastmas- ter for the occasion: Miss Grace Jo Burnett will sing; Misses Helen and Josephine Power are to play a piano duet; toasts to George Washington will be given by the League presi dent. Joyce Banish, and by other of ficers. Helen Powers' committee has been decorating the north parlor, where the banquet will be held. The tables will have favors appropriate to the holiday and spring blossoms for, decorations. The menu committee, under Mild red Walker's direction, has arranged all soliciting and buying of food. The members of the Ladles' Aid are to help this committee in senilis;. It was announc ed today. Dr. page la one of the out standing Bible teachers of this coun try. DOLLAR 53 CENTS SALEM. Ore. (UP) J The American farmer In 1033 received 33 cents of the consumer's dollar, the agricul tural adjustment administration re ported today. In 1932 he received 33 cents. The administration pointed out that in 1929, when farm prices were com paratively good, the farmer received 47 cents out of each dollar spent for food, with 53 cents going to process ors aud distributors. Such price lev?ls can be restored only through increas ing farm prices faster than retail price or reducing costs of processing and distributing . The agricultural adjustment ad ministration expects that the fann er's share will be increased somewhat this year through various federal agencies set up. I corps of the Salvation Army next Sunday.
