Norton Saturday after noon In the Injunction suit of Mrs. Jennie Barr against Floyd Rlpney, V. J. Emerick, C. W. Balm and others over building of a fence on farmland In the Upper Applegate country. Mrs. Barr contends that the present fence line has stood for over 40 years. The Rippeys, et al, claim that they are proposing to build the new fence on & survey made by Herman D, Powell. V. J. Emerick, former mayor of Medfofd and Mrs. Pat Swayne were among the witnesses. The fence la located on what is known as the "Palm 40" and adjoins the Pat Swayne farm. The court announced It would hand down an opinion the end of the coming week. Porter J. Neff. counsel for Rlppey and T. J. Enrlght, counsel for Mrs. Parr, announced they would submit memoranda to the court the first of the week. . Dissolution of a temporary injunc tion against the building of the fence Is sought. OPEN HOSE NOT ALLOWED. The use of an open hose in watering is prohibited, nor shall any nozzle used in sprinkling be larger than one-fourth inch in diameter. 2. WASTE NOT ALLOWED. Water shall not bo furnished except through a meter to any premises where there are defective leaking pipes or fixtures. Water allowed to run to waste down sidewalks, streets or gutters as a result of the sprinkling of lawns, gardens or park strips is prohibited. When any such waste is discovered the water shall be shut off from the premises. 3. TURN OFF IN CASE OF FIRE. Friends of Tollefson In the Central Point district, and other portions of the county, have so far taken no steps to bring a pardon plea to tha attention of Oovernor Meier, as re ported. Tollefson was sentenced by Circuit Judge H, D. Norton upon a plea of guilty to perpetrating the bank, rob bery hoax in an effort to cover up gambling losses.
