Gasoline Stolen The gasoline tank
at the Valley Fuel company was bro-
ken Into Friday evening, and five

to a report at the city, police station.

FENCE QUESTION
Testimony waa heard by Circuit
Judge H. D. Norton Saturday after
noon In the Injunction suit of Mrs.
Jennie Barr against Floyd Rlpney,
V. J. Emerick, C. W. Balm and
others over building of a fence on
farmland In the Upper Applegate
country.
Mrs. Barr contends that the present
fence line has stood for over 40
years. The Rippeys, et al, claim
that they are proposing to build
the new fence on & survey made by
Herman D, Powell.
V. J. Emerick, former mayor of
Medfofd and Mrs. Pat Swayne were
among the witnesses. The fence
la located on what is known as the
"Palm 40" and adjoins the Pat
Swayne farm.
The court announced It would
hand down an opinion the end of
the coming week. Porter J. Neff.
counsel for Rlppey and T. J. Enrlght,
counsel for Mrs. Parr, announced
they would submit memoranda to
the court the first of the week. .
Dissolution of a temporary injunc
tion against the building of the
fence Is sought. The action has
been pending for several weeks.

Failure to comply with the following rules will invoke,
a penalty as provided by Resolution Number 24.
1. OPEN HOSE NOT ALLOWED. The use of an
open hose in watering is prohibited, nor shall any
nozzle used in sprinkling be larger than one-fourth inch
in diameter.
2. WASTE NOT ALLOWED. Water shall not bo
furnished except through a meter to any premises
where there are defective leaking pipes or fixtures.
Water allowed to run to waste down sidewalks, streets
or gutters as a result of the sprinkling of lawns, gardens
or park strips is prohibited. When any such waste is
discovered the water shall be shut off from the
premises.
3. TURN OFF IN CASE OF FIRE. All consumers
of water shall close all faucets and fixtures immediate"
ly upon sounding of a fire alarm. The water shall not
be turned on again until the Fire Department has
ceased to use the water supply to extinguish the fire.
The Fire Department will indicate with the alarm when
they have ceased to use the water.

appeal of L. Alvln Tollefsort of Cen
tral Point under a two year prison
sentence (or the perpretratlon of the
Central Point bank robbery hoax last
April, wm be completed within the
next 15 days the time allotted for
the filing. To lief son is at liberty
on 452500 bonds furnished by his
iatner and Elmer Hull of Central
Point.
The appeal, In all probability, will
attack constitutionality of the Ore
gon law providing that a person can
waive grand Jury Indictment and ap
pear before the court on an Infor
mation, filed by the district attor
ney, as was done In the Tollefson
case, and others In this county the
past four years. The law was passed
by the legislature as a money and
time saver.
Attorneys hold that the "direct
Information" law conflicts with both
the Oregon and United States con
stitutions Inasmuch as both provide

Friends of Tollefson In the Central
Point district, and other portions of
the county, have so far taken no
steps to bring a pardon plea to tha
attention of Oovernor Meier, as re
ported. Tollefson was sentenced by Circuit
Judge H, D. Norton upon a plea of
guilty to perpetrating the bank, rob
bery hoax in an effort to cover up
gambling losses. It has been con
clusively shown that Tollefson was
the chief sufferer by reason of hU
acts.
