of enactments respecting- motor
vehicles which the a 1st day after

.Motor vehicle registered at any
time during the period from 'June
4 to June 30. inclusive, will be
licensed for iif per eent off of the
annual fee prescribed by the pres
ent law. In subsequent years this
reduction will Inure to vehicles
registered on and after April 1,
hut in the present year it can only
he applied to registrations made
nfter the amendment becomes ef
fective. The provisions for a 50
per cent reduction after the ex
piration of the first half of the
registration year and a 75 per cent
reduction after, three-fourths of
the year has expired are also em
bodied in the new law.
The owner or operator of a
transient automobile registered in
another state may no longer es
cape responsibility for accidents
caused by h i m , by a void ing t he
service of papers Jn a suit ,In ,the
courts In this state, as chapter 359
provides that "the acceptance by
a non-resident of the rights and
privileges conferred by the laws
of the state of Oregon to use the
roads, highways and streets of this
.state, as evidenced by his operat
ing, a motor vehicle thereon, shall
he deemed equivalent to nn ap
pointment by such non-resident of
the secretary of state of the state
of Oregon or his successor in of
fice to be his true and lawful at
torney, upon whom may be served
all lawful summons and processes
against him growing out of any
accident, or liability collision In
which said non-resident may be
involved while operating a motor
vehicle upon such highway."
Service of summons in this man
ner will support a judgment upon
which when transferred to the
pa Ice of residence of the defend
ant, recovery may be had.
A motor vehicle owner or ope
rator who transports another per
son as his guest without charge
will be subject to a cause of ac
tion for damages by such guest if
In un accident which is intentional
on the partof such owner or ope
rator, or which is the result of his
gross negligence or Intoxication or
his reckless disregard of the rights
of others, the guest sustains in
Jury, deathor loss. Thus chapter
4 Ml modifies the sweeping statu
tory rule sought to be established
by the 1927 legislature, but found
unconstitutional by the supreme
court and repealed in lj-'9, declar
ing that the acceptance of a free
ride in a motor vehicle should be
presumed to be a waiver by the
guest of any liability for accidental
injury caused by the owner or
operator of the vehicle.
Appointments by the secretary
of state of. an adequate number of
Htate traffic officers to effectively
patrol und police the highways is
provided by chapter ::iG. At
present ths number is restricted to
ITi, but the new law removes this
limitation.

Chapter 437 provides that If a1
motor vehicle licensed under the
lows nf this state shall be acci- I
dentally destroyed so as to be in
capable of further operation, be
fore 50 per cent of the registra
tion period has expired, the per
son, firm, association or corpora
tion in, whose name such motor
vehirle i registered, shall be en
titled to a return! of that portion
if the license fee in j-uch motor
vehicle applicable to the unexpired
portion of the registration year.

delivered to the secretary of state.
This law also authorizes the secret
tary of state to refund any part of
a fee erroneously paid. Claims for
a refund must be filed with the
secretary of state within six
months from tne date of destruc
tion of the motor vehicle, or er
roneous payment, as the case ;
may be.
The familiar yellow cardboard
i tags which formerly served as
i temporary license plates have been
supplanted by a windshield sticker.

Anyone contemplating removal
from Oregon to another state
within 30 days after the beginning
of the registration year luring the J
month of July, in 1H30, and suc
ceeding years) may obtain a per
mit from the secretary of state to
operate his motor vehicle over the
roads and highways of this state
in a single continuous trip to reach
the state ot which he is removing.
Tliis is provided for by chapter
3!M), which prescribes a fee for
the issuance of such permit equal
to one-twelfth of the full annual
license fee applicable to such ve
hicle. ln(Wl operation under the
permit is prohibited.
Chapter 4;i (j applies the prin
ciple of reciprocity to the opera
tion in Oregon for compensation
or profit of motor vehicles regis
tered in bordering slates. Spe
cifically, the secretary of stale may
license without charge a commer
cial vehicle registered in another
statu the laws of which provide
for reciprocal operating agree
ments, and such licenses will le
galize the use of such vehicle
throughout the registration year
over a route or routes limited to
10 miles of Oregon highways. In
practice this right is confined to
the owners of motor vehicles regis
tered in Washington and Idaho,
as those ai the only neighboring
states whose laws grant "like ex
emptions and privileges to vehicles
duly registered and Iciensed under
the laws of and owned by resi
dents of this state."
A motor vehicle may be
equipped with three spot lights or
auxiliary lamps under chapter 328,
but not more than two of such
lamps'shall be lighted at nny one
time... Any spot lamp or auxiliary
lamp, controlled by the steering
mechanism of the vehicle or at
tached to the vehicle in such n
manner that the light therefrom
be directed parallel to the axis of
the vehicle, shall be equipped
with the same devices applicable
to head lamps and regulated ac
cordingly, and must be attached to
or upon the vehicle not higher
than the head lamps nor more
than 1 8 inches aove the surface
of the roadway upon which the
vehicle stands.
Printing by the state of books
containing the name and address
of every motor vehicle owner in
the state, with a description of the
vehicle, and the license number
assigned to it, nnd the distribution
of the books to county clerks and
assessors and to the peace and
police officers of tiie state, county
and municipalities is required to
be discontinued by chapter 230.
The lists are still available from
private sources, and a saving to
the state of approximately $20,000
is calculated to be affected by this
measure.

titled to cluim a refund of the
state tax paid on gasoline used In
transporting the mails. Chapter
requires that a claim under
this provision shall be in the form
of an affidavit subscribed to by
the. claimant under oath and that
it shall be filed with the secretary
of state within one year frofti the
date of the purehu.se or purchases
upon which the refund is claimed.
The specific requirement in the
former law that license number
plates for motor Vehicles be of a
distinctly different color or shade
each year has been removed by
chapter 409. The secretary of
state Is now invested with the im
plied power to furnish plates with
the same color combinations in
definitely, the only statutory
specification being that there shall
be at all times a marked contrast
between the color of the number
plates and that of the numerals
or letters thereon.

tions of driving a motor vehicle
while under the influence or in
toxicating liquor are made a felony
by chapter 4!. First offenders
are subject to a fine of not less
than $100 and not more than $.lui,
or to improsinment in the county
Jail for not less than tiO days or
more than six months. The pen
alty for a second violation is im
prisonment In the state peniten
I iary for from one 'to five years,
and In addition, u fine of from
$2ni) to $;j00. Conviction of driv
ing a motor vehicle while intoxi
cated or while being under the
influence of In toxica tins liquor
also automatically revokes the de
fendant's opera tor's license. Dis
trict attorneys are required to re
port to the secretary of state,
monthly, the names and addresses
of all persons convicted of driving
motor vehicles while Intoxicated,
together with the numbers of their
respective license plates and the
numbers or the cancelled licenses.
A person accused of driving while
intoxicated may be taken before a
duly licensed physician and ex
amined, and the testimony of such j
physician may be admitted ut the J
trial of such person.
