McKlrpy, chnrged with burglary at Ashland three weeks ago, will begin in the circuit court tilts nfternoon, and the chief witness against tho defendant will be Uichard Hunn, a 13-year-old Oakland, Calif., boy, whom he is alleged to have in duced to eommfrt the burglaries. Mc Elroy is about 27 years of age. Richard ran away from home and met McKIroy at San Jose. Calif., the pair coming north according to the boy'M story, finally reaching Ashland, where they were arrested. Kistler, an Ashland baker, "for amount due for shipments of flour in 11(23. Kistler admitted owing $213 on a flour shipment, but filed a counter mi it asking for $(i!Hl, less the amount conceded, or a net total of $477, for failure to deliver a carload of flour. Ho alleged that, before he asked for delivery, the price of soft and hard wheat flour rose, and that when he nsked for delivery It was refused, and that $6!t represented the increase in value of tho flour. The defendant was represented by O. O. P.oggs and A. J. Flelgel, and the milling company by Hiigs and Hritfgs.
