Established before the town started CallinR attention to the fact that the last legislature passed legislation authorizing the state highway com mission to institute suit to' invalidate the Warren Brothers' paving patents. .Senator C. M. Thomas, of this cliy. recently wrote the commission and Attorney lleneral lirown asking why lecal proceedings to such an end have net iieen brought. The legislature regarded the pav ing patents as invalid, and the inten tion of the legislation was that they should he set aside in order that the state might lay the pavement covered by them without paying a royalty to tlio Warrens, according to Senator Thomas. Sinco the enactment of the legisla tion. Attorney Oeneral Brown has rendered an opinion indicating that .the patents are invalid, and the com ! mission has been withholding the royalty charge in awarding contracts on the pavement of the Warrens, but j no suit has been instituted, j Instead vt authorizing the Institu ; tion of legal proceedings the commis sion is said to have been considering a compromise proposal from the War rens which would c-bviate any litigation. In part: I The publication that a $5,000,000 Ponding Din would ue lnirouuceu ai the special session of the legislature called for January 12, 1920, leads to the thought that it would be wise to possess facts In regard to the work ings of the legislation passed by the last assembly, rather than to wait un til the committees convene. I would at this time inquire con cerning chapter 17G of general laws of 1919, and especially to sections one and two, which read as follows: Section 1 It shall bo the duty of the attorney general of the state of Oregon to investigate as to tho valid ity of any alleged patent or copyright on designs, material or use of mater ials, process or mixtures in the con struction of highways, bridges and culverts, and to' advise said commis sion as to the validity ot any alleged patent. Section 2 Upon advice of tho at torney general that in his opinion any such alleged patent Is involved or of doubtful validity, tho state highway commission shall, if it deems tho use of said patent to be advantageous In the construction of state highways, uso or contract for the use of the same in such construction." The legislation was Intended to' strike at tho "Uithulithlc" patents, particularly the one covering tho mix ing of the inateriuls, which many of us believed to be invalid, and which, if I remember correctly, the attornoy general reported was of "doubtful validity." The perennial threut from Medfprd and other Rogue River valley cities to close the lower Rogue to commercial fishing has stirred up the residents of Curry county as usual, and they are out with a'determinatlon to block any such bill at special session of the legislature. Fishermen down there have organized to fight, what they term "hold-up" and the Marshflcld chamber of commerce is backing their efforts. It is argued that no action will be taken to put the greatest industry Curry county has out of business.
