I have always con tended there is no evidence of water competition west of the Buffalo-Pittsburg line, and the commission holds thero Is no such competition from Chicago and St. Louis. "Hence, I am of the opinion that nn absolute long and short haul clause provision from territory where there Is no water competition or no water shipments of material conse quence would be legal, unless the car riers can show that the reduction In rates would result In the confiscation of tho railroad property. Pending a hearing which has been fixed for Tuesday, United States Judgo Wolvorton has granted a tem porary restraining order Inhibiting the defendants from enforcing the state law. Tho Oregon law, passed by the last legislature provides that trainmen cannot be worked more than H con secutive hours and that train dis patchers can be on duty only nine consecutive hours, save in times of emergency when they can work four additional hours. The federal law, enacted by con gress In 1907 allows railroads to work trainmen 1G hours and permits dispatchers to work for 13 consecu tive hours. The railroad pleads that it cannot comply with the state law owing to The arrangement of its system of divi sion points, and charges that the Ore gon law is an "unwarranted Interfer ence with Interstate commerce."
