to Join In a petition to congress at Its
next session, to enact n long and
short haul clause. It Is purposed to
send a delegation of representative
western business men to Washington,
D. C, to work for tho measure.
Henry M. Stephens, chief counsel
for the people In the famous Spokane
freight rato case, In which the Inter
state commerce commission announc
ed Us decision on July 25, said In
discussing the foregoing that, while

thinks additional advantages may bo
secured by urging congress to
amend tho fourth section of the in
terstate commerco act, so as to make
it absoluto and without promise from
Interior points.
"Commissioner Iano' holding in
tho Nevada and Arizona cases," Mr.
Stephens added, "Is to the effect that
there is no water competition In the
Chicago-St. Louis territory, notwith
standing Commissioner Prouty says
the commissioners are unable to state
that water competition does not have
any effect upon rates from Chicago
and St. Louis. I have always con
tended there is no evidence of water
competition west of the Buffalo-Pittsburg
line, and the commission holds
thero Is no such competition from
Chicago and St. Louis.
"Hence, I am of the opinion that
nn absolute long and short haul
clause provision from territory where
there Is no water competition or no
water shipments of material conse
quence would be legal, unless the car
riers can show that the reduction In
rates would result In the confiscation
of tho railroad property. This, I am
confident, the companies can not
show."

serting that the state and federal
statutes regulating the hours of train
men can work are conflicting and that
the state law Is unconstitutional as
a result, the Oregon-Washington
Itnllroad and Navigation Company
has Instituted n suit against members
of the Oregon railroad commission,
Attorney General Crawford and n
number of district attorneys.
Pending a hearing which has been
fixed for Tuesday, United States
Judgo Wolvorton has granted a tem
porary restraining order Inhibiting
the defendants from enforcing the
state law.
Tho Oregon law, passed by the last
legislature provides that trainmen
cannot be worked more than H con
secutive hours and that train dis
patchers can be on duty only nine
consecutive hours, save in times of
emergency when they can work four
additional hours.
The federal law, enacted by con
gress In 1907 allows railroads to
work trainmen 1G hours and permits
dispatchers to work for 13 consecu
tive hours.
The railroad pleads that it cannot
comply with the state law owing to

sion points, and charges that the Ore
gon law is an "unwarranted Interfer
ence with Interstate commerce."
