This matter was definitely settled at the adjourned meeting of the council Monday evening, at which time the mayor and recorder were authorized to enter into a contract with Colonel Newport along the same lines and on about the same basis as pertains to the established irrigation system now in vogue in the district embraced in the area running west from Fourth street, and in accord ance with instructions at the previous meeting City Attorney* Warner had prepared an ordinance covering the salient points that should be made binding on both parties to the con tract, which document was given its first reading at the meeting. As there is about eight acres of low land in the addition, included in which is the city park, the mayor and city recorder were authorized by the council to petition the secretary of the interior to eliminate this from a water right, so that when the city began to furnish the addition with irrigation water it would not be com- pelled to pay a maintenance fee on that portion of the district. Mr. Newell gave his sanction to this, and he will also recommend to the de- partment that it he eliminated. The principal reason for the desire of the owner of the addition to have the lands therein become part of the city's irrigation system is that under it every property owner would have to hear his or her proportionate share of the cost of the water, where as now the burden all falls on the owner of the addition.
