Published: May 18 and 25, June 1, 8. 15 and 22. 2005 PUBLIC NOTICE BEFORE THE MORROW COUNTY COURT OF MORROW COUNTY AN ORDINANCE REQUIRING THE CONTAINMENT OF SOLID WASTE WHICH IS DELIVERED TO COUNTY TRANSFER STATIONS AND IMPOSING PENALTY FOR VIOLATION No. MC.01-05 WHEREAS, ORS 203.035 authorizes Morrow County to exercise authority within the County over matters o f Coun ty concern; and WHEREAS, Morrow Coun ty has established two solid waste transfer stations on both State Highway 74 approxi mately 2 miles south o f Lex ington. Oregon (South End) and at the intersection o f State H ighw ay 730 and C ounty Road # 490 known as Bomb ing Range Road (North End); and W HEREAS, persons have been transporting solid waste to the South End Transfer Sta tion which is not contained or covered, resulting in substan tial littering along the roadways leading to the transfer station; and WHEREAS. Morrow Coun ty has previously established fees for the deposit o f solid waste at said transfer stations; and WHEREAS, it is in the best interests of the people o f Mor row County to inhibit and di minish the littering o f the road ways leading to the transfer sta tions. NOW. THEREFORE, THE COUNTY COURT OF MOR ROW COUNTY ORDAINS AS FOLLOWS SEC TIO N 1 T ITLE OF ORDINANCE T his o rd in a n c e sh all be known, and may be cited, as "The Penalty for Transporting Uncontained Solid Waste Or dinance’’. SECTION 2 IM POSITION OF A D D I TIONAL FEE The caretakers of the solid yvaste transfer stations located approximately 2 miles south of L exington on H ighw ay 74 (South End) and at the inter section o f State Highway 730 and B om bing R ange road (North End) shall impose, in addition to any regular fee as sessed for deposit o f solid waste at said transfer stations, a penalty in the sum o f $ 10.00 upon each load or deposit which is brought to the trans fer station and which is not cov ered and contained so as to pre vent leakage, spillage or loss during transport SECTION 3 D IS P O S IT IO N OF A S SESSMENT All moneys collected pursu ant to this ordinance shall be deposited to the Solid Waste Transfer station line item in the General Fund of the County, which is line item number 101- 123-340 South End Transfer Station and 101-123-540 North End Transfer Station in the Morrow County budget. SECTION 4' EFFECTIVE DATE The North End Transfer Sta tion cannot operate until this condition o f DEQ permit is sat isfied. Accordingly, this Ordi nance is declared to be an Emergency Ordinance pursu ant the provisions o f ORS 203.045 (9) and shall take ef fect immediately upon the date o f adoption.
