"Judge Hamilton refused to grant a certificate of probable cause, although it is the usual cusl uu to grant such au appeal in all case of capital punish ment. Charles F. Kent Died at Honolulu, November 17. A letter from the Red Cross society gives particulars of the death of Charles F Kent, Novembor 17, at Honolulu. He wai about '25 years old, was born lu Iowa, and for the past 10 years had resided near Sniilhlleld, this county. Young Keu I was ouo of the 27 that left Eugene under the last call for men to fill the Oregou regiments to full fighting strength, leaving Han Francisco .October 17. When the transport readied Honolulu he and ouo other were left there on aooouut of sickness. No acoount of his death has yet been glveu lu the papers, probably on aocouut of tho faot that uo cubic connects the Hawaiian Islands with the main laud. The report of City Superintendent E D Kessler shows the enrollment lu the public tchools of this city at the close of the third month of tlio present school year was 820, a largo increase over last year. James H Y'ates, a well known resi dent of the western end of the county oled suddenly yesterday at his home near Elmlra, from neuralgia of the heart. Ho was making preparations lu drive to Eugene when the end came. Mr Y'ates was born iu Missouri, April 18, 1841, aud was therefore agod 57 years 8 mouths aud 2 days. Ho removed to Oregou about IS yoars ago, aud had since resided near Elmlra, this county. Mr Y'ates leaves quite a large family. whn reside here with the exception of two sons, who resldo a short distance east ot The Dalles.
