to be executed next Friday by hang

thus be given a lease of life alsHit three

supreme court.
"Judge Hamilton refused to grant a
certificate of probable cause, although
it is the usual cusl uu to grant such au
appeal in all case of capital punish
ment. "But where tills is rehis o by the
trial judge it has nearly always been
gruultd by a justice ot t tie supreme
court. No such a request iu a case of
sentence for capital punishment was
ever refused by Governor Lord when
he was on the bench.
"Section 1410 of the code, in the
opiuion of aide cilminal lawyers,
should be amended so that a seuteuce
of capital punishment should become
"ipse facto" proof of probable cause
and a ground lor appeal, as u matter of
right to the coudemned man, not a
matter of grace with a jud;e.
"Within the tenure of one of the
present justices four men have been

pi obable cause, the state opposing by

torneys, and it appearing to me, one of
the justices ot the supieiue court of the
stale of Oregon, that the defendant,
Claude Brautou was Indicted, tried
and convicted, in the circuit court of
Lane couuty, Oregou, of the crime of
murder in the first degree, alleged to
have been committed In the killing of
one John A Liun, and having been
sentenced to be hanged on December
'23, 1S9S, he has perfected an appeal
from the Judgment thus reudercd and
tiled iu the ofilce of the clerk of the
supreme court of Oregon a judgment
roll, aud upon Inspecting the same I
certify that in my opinion there is
probable cause of appeal.

the Oilman house, on First and Alder

per month. It was then that First

A letter from the Red Cross society
gives particulars of the death of Charles
F Kent, Novembor 17, at Honolulu.
He wai about '25 years old, was born
lu Iowa, and for the past 10 years had
resided near Sniilhlleld, this county.

left Eugene under the last call for
men to fill the Oregou regiments to
full fighting strength, leaving Han
Francisco .October 17. When the
transport readied Honolulu he and
ouo other were left there on aooouut of
sickness. No acoount of his death
has yet been glveu lu the papers,
probably on aocouut of tho faot that
uo cubic connects the Hawaiian Islands
with the main laud.
B F Kent, father of tho boy, resides
on West Fifth street, this olty, and he
has oue sister, who In attending the
Eugene publlo schools. His mother
is dead.
The report of City Superintendent E
D Kessler shows the enrollment lu the
public tchools of this city at the close
of the third month of tlio present school
year was 820, a largo increase over last
year.

Willamette Poultry Association opened
Its doors to the public tills morning.
The exhibit is not as large this year
as last, hut the quality aud high grade
of the Individuals hid fair to excel
those shown last year.

guinea fowls, two pea fowls and two

James H Y'ates, a well known resi
dent of the western end of the county
oled suddenly yesterday at his home
near Elmlra, from neuralgia of the
heart. Ho was making preparations
lu drive to Eugene when the end came.
Mr Y'ates was born iu Missouri,
April 18, 1841, aud was therefore agod
57 years 8 mouths aud 2 days. Ho
removed to Oregou about IS yoars
ago, aud had since resided near Elmlra,
this county.
Mr Y'ates leaves quite a large family.
whn reside here with the exception of
two sons, who resldo a short distance
east ot The Dalles. They hove boon
untitled ot their father's death and are
expected to arrive lu time to attend
the funeral.
Deceased was a member of the Q A
R, aud was quite prominent lu the
oirule In which he moved.
The funoral will occur tomorrow to
the Inmau cemetery.
