This includes adopting: • New federal standards for boilers and process heaters, stationary internal combustion engines, nitric acid plants, and crude oil and natural gas production, transmission and distribution. • Newly amended federal standards The proposal includes revising previously adopted federal standards for internal combustion engines that LRAPA authority would only be delegated from EPA for those applicable sources required to have an Air Contaminant Discharge Permit (ACDP) or Title V Operating Permit. LRAPA also proposes to repeal the sections in LRAPA’s title 44 pertaining to Compliance Extensions for Early Reductions and Accidental Release Prevention, and instead adopting those by reference from the federal versions of those rules/programs. The draft also adds an annual reporting requirement to the sections pertaining to Gasoline Dispensing Facilities (GDFs). WHO IS AFFECTED: Anyone who is subject to LRAPA Permitting Rules PUBLIC HEARING: Location: LRAPA Meeting Room 1010 Main Street Springfi eld, Oregon 97477 Date: Thursday, November 12, 2015 Time: 12:30PM Copies of the proposed rules as well as the rulemaking notice document are available for review at the LRAPA offi ce NOTICE OF HEARING before the Board of Directors for Lane Regional Air Protection Agency Rules and Regulations Modifi cation of LRAPA Title 15, Enforcement Procedure and Civil Penalties Summary of proposed rulemaking: Amend LRAPA Title 15 to replace the civil penalty fi ne amounts that are currently in Title 15 with the civil penalty amounts adopted by EQC and are current in OAR 340, Division 12, to be used when calculating civil penalties. This fi rst part should be done because LRAPA does not have authority to establish penalty schedules – the legislature delegated that to the EQC. Currently, LRAPA’s penalty matrices are different from the DEQ’s. The other changes include updates and corrections to make Title 15 in harmony with OAR 340, Division 12.
