AND Sainy Days Clauso in Charters The rainy days clause in charters has always toecn. a prolific source of annoyance and trouble to shipmasters and consignees. By a recent decision in the United States district couit, of Oregon, it is set at rest. The syllabus at the decisions is as follews: Balfour. Guthrie, et. al. v. Wilkin. et. al., cargo of the Beulcdi. Suit in Admiralty. USAGE RAINY DAY. The phrase "rainy day" being of itself indefinite and uncertain, the sense in which it was used in a par ticular contract may therefore be ttlmwn hv the surrounding circumstan ces including the usage of the par ticular port or trade to which tlie contract relates. CHARTER. PARTY RAINY DAY CLAUSE IN CONSTRUCTION OF k viTiat.riictinii uartv provided that the charters should bore 30 working days, not counting "rainy days" in which to load a vessel al portland, Or.. Held, that the phrase "rainy days" was intended to apply only t the days on which the ironfall vm Midi s to prevent the loading of t". ves-els with -of..tiT f,T ponvnieiicti li.e actual facilities of tfhe port for so doing, Iwaag considered. VDregon, is in .contemplation of law made at the latter place and therefore the condition as-d convencies of such port for loading vessels with grain or the established usage thereof that sub ject may be shown to explain the meaning and use ot dubious ana un certain phrases in the same as for in stall ce 'rainy days. " -DEMURRAGE 31ILLS OP LADING. The person to whom a bill of lading of a cargo is made, or the indorsee thereof, has the legal property in the Kjitiifi. free from the lien for demur rage, and therefore the owners of a vessel w ith an overdue .claim for de murrage against the charterers, for which by the stated tennis -of the char ter party they have a lieu upon the car o, are not bound to sign unqualified bills of lading to the charterers for ili pnrcro until sudli claim for demur rage is satisfied; and if such vessel is detained in port for want of a clear ance, which by terms of charter party the -charterers were to obtain, but did not for want of the bills of lading, ftiidh detention is nevertheless the fault of the charterers in not paying the demurrage or accepting urns ui lading subject to the same, and. there fore they are liable to the owners for the damage arising from such detec tion. Xot the Mud Dry First." Here is a capital lesson that may be impressed upon the memory of both young and eld: Mr. Spurgeon, in walking a little way out of London to preach, chanced to get his panta loons quite muddy. A good deacon xnet him at the door and desired to take off some of the mud. ""Oh, no," said Mr. S., "don't you soe it is wet, and if you try to brush it now, you ;n vni-i fho ahnin into theelotk? Let it dry, when it will come off easy enough and leave no mark." So, when men speak evil of us falsely throw mud at us don't be in a hurry about brushing it off. Too great eagerness to rub it off, is apt to rub it in. Let it dry, by and by, if need be. a little t-ffort -will remove it. Don't foster candal about yourself or others, or xroiible in a society, or in a church, by haste to do something. Let it alene: let it dry: it will be more easily eradicated than you think in the first 4 XV. FKRGVSOX, Contractor and Builder, All kind; of Carpenter ami Joiners Work proninth ami neatly evecuteil.
