The rainy days clause in charters
has always toecn. a prolific source of
annoyance and trouble to shipmasters
and consignees. By a recent decision in
the United States district couit, of
Oregon, it is set at rest. The syllabus
at the decisions is as follews:
Balfour. Guthrie, et. al. v. Wilkin.
et. al., cargo of the Beulcdi. Suit in
Admiralty.
USAGE RAINY DAY.
The phrase "rainy day" being of
itself indefinite and uncertain, the
sense in which it was used in a par
ticular contract may therefore be

ces including the usage of the par
ticular port or trade to which tlie
contract relates.

The person to whom a bill of lading
of a cargo is made, or the indorsee
thereof, has the legal property in the

ter party they have a lieu upon the car
o, are not bound to sign unqualified
bills of lading to the charterers for

detained in port for want of a clear
ance, which by terms of charter party

not for want of the bills of lading,

fore they are liable to the owners for
the damage arising from such detec

Here is a capital lesson that may
be impressed upon the memory of
both young and eld: Mr. Spurgeon,
in walking a little way out of London
to preach, chanced to get his panta
loons quite muddy. A good deacon

said Mr. S., "don't you soe it is wet,
and if you try to brush it now, you

mud at us don't be in a hurry about
brushing it off. Too great eagerness
to rub it off, is apt to rub it in. Let
it dry, by and by, if need be. a little
t-ffort -will remove it. Don't foster
candal about yourself or others, or
xroiible in a society, or in a church,
by haste to do something. Let it
alene: let it dry: it will be more easily
eradicated than you think in the first
