The board ap plied to Attorney-General Cham berlain, who gave his opinion of the course suggested to be an un warrantable discrimination, lie says the discrimination suggested would come within the letter of tne law and is prohibited by it. Acting upon in is decision tne board noti tied Mr. Koehler that such rate to the state institutions would be a liscrimination against the other high schools of the state, and therefore recommends that he ex tend the same rate to all chartered institutions of learning within the state. Tbe board will insist on the extension of this rate to all the chartered institutions of learning or else a cancellation of the rate to fcngenr In regard to the alleged dir?crim inatlun in the matter ot the ituuu grant rate from Albany, Koehler explains to the board that the same was made to enable grants coming up on the west to coi.tinue south from Albany on the east side. No town being sit uated similar to Albany. The ex planation was considered satis factory by the board. ror ten days the board has been working on the freight tariff schedule for the Southern Pacific. be board leaves merchandise the same as before, but proposes a slight reduction on grain, flour. stock, fruit, wood, lumber, veget ables, etc. The .schedule will be adopted or modified next week. The statement that the Itata will be released upon a bond 01 f ivj.oou being bled, is some what premature. Application for release has not yet been made, though some such action will pro bably be taken in the immediate future. The matter would have been arranged before now but for tin; fact that some doubt exists as to the legality of the acceptance by Judge Ross of the bonds, and his orddring the vessel's release while acting outside his own district. When Page and Kels, attorneys for the congressional party in this city, make their application and bonds are fixed, the amount will be forthcoming, as men of standing are prepared to qualify at once. When the Itata is finally released she will leave San Diego for this port, where tlie necessary repairs will be made, after which she will return to San Diego in time for a hearing of th case in tbe district court at Los Angeles, September 13th.
