Smoke Signals 5 MARCH 1, 2004 Wednesday, February 4, 2004 5:02 p.m. Meeting was called to order by Tribal Council Chairwoman, Cheryle Kennedy. A quorum was present. Present was Jack Giffen, Jr., Val Grout, Bob Haller, Cheryle Kennedy, Ed Larfaen, Reyn Leno, Jan D. Reibach, Valorie Sheker-Robertson and June Sell-Sherer. Invocation was done by Val Grout. PREVIOUS MINUTES APPROVEAMEND O Reyn Leno moved, Ed Larsen seconded to approve the January 28, 2004, Tribal Council regular meeting minutes as presented. Motion car ried 8-0-0. NEW BUSINESS LEGISLATIVE ACTION COMMITTEE D Oregon Youth Conservation Corps Youth Crew Grant Applica tion. June Sell-Sherer moved, Valorie Sheker-Robertson seconded to adopt Resolution No. 010 04 to 1) approve the grant application to the Oregon Youth Conservation Corps (OYCC) for partial funding of the 2004 Natural Resources Division OYCC summer youth crews, grant not to ex ceed $11,111; 2) indirect costs would be paid for by the Tribe, which are not covered by the grant; and 3) authorize the Natural Resources Divi sion Manager, with the assistance of the Tribal Attorney, to finalize and execute said grant if awarded. Motion carried 8-0-0. B Software Upgrade and License Approval. Jack Giffen, Jr. moved, Jan D. Reibach seconded to adopt a motion authorizing the Finance Officer, with the assistance of the Tribal Attorney, to finalize the Support Services Agreements, and approve the purchase of needed software up grade packages as budgeted. Motion carried 8-0-0. B Enrollment Infant Determination Denial. Valorie Sheker Robertson moved, Jan D. Reibach seconded to adopt Resolution No. 011 04 denying membership to minor, John Doe (date of birth 11-6-03), because, based on the investigation and recommendation of the Enroll ment Staff, the applicant does not meet the enrollment requirement un der the Tribal Constitution and th Enrollment Ordinance. Motion car ried 8-0-0. B Enrollment Infant Determination Denial. Reyn Leno moved, Valorie Sheker-Robertson seconded to adopt Resolution No. 012 04 de nying membership to minor, Jane Doe (date of birth 9-23-03), because, based on the investigation and recommendation of the Enrollment Staff, the applicant does not meet the enrollment requirement under the Tribal Constitution and th Enrollment Ordinance. Motion carried 8-0-0. B Enrollment Infant Determination Approvals. Jan D. Reibach moved, Valorie Sheker-Robertson seconded to adopt Resolution No. 013 04 approving six (6) minors numbered 5368 through 5373 for Tribal mem bership, because, based on the investigation and recommendation of the Enrollment staff, the minors have been found to meet the eligibility re quirements for enrollment as defined in the Enrollment Ordinance and Tribal Constitution. Motion carried 8-0-0. B Enrollment Emergency Determination. Val Grout moved, Ed Larsen seconded to adopt Resolution No. 014 04 approving Tribal mem bership for a minor who is numbered 5375, because, based on the investi gation and recommendation of the Enrollment Staff, the minor meets the eligibility requirements for enrollment as defined in the Enrollment Ordi nance and Tribal Constitution and is eligible for emergency determina tion under Section (c)(2)(C) of the Enrollment Ordinance. Motion car ried 8-0-0. B Enrollment Infant Determination Approvals. Bob Haller moved, June Sell-Sherer seconded to adopt Resolution No. 015 04 approving two (2) minors numbered 5376 and 5377 for Tribal membership, because, based on the investigation and recommendation of the Enrollment staff, the minors have been found to meet the eligibility requirements for enroll ment as defined in the Enrollment Ordinance and Tribal Constitution. Motion carried 8-0-0. ANNOUNCEMENTS B General Council Meeting is scheduled for Sunday, March 7, 2004, at 11 a.m. in the Tribal Community Center. OTHER BUSINESS B Bob Haller moved, Reyn Leno seconded to adopt Resolution No. 016 04 which amends Resolution No. 163 03, by (1) increasing the amount of the loan to Spirit Mountain Gaming, Inc. to an amount not to exceed $25,850,000, and (2) authorizing the Finance Officer to use up to $25,850,000 of the Tribe's line of credit for such purpose. All other provi sions of Resolution No. 163 03 not amended remain in full force and effect. Motion carried 8-0-0. B A Tribal member sought clarification on the "burning" of the sweat lodge located on Tribal property. Discussion followed. Cliff Adams, General Manager, will meet with the Tribal Member to address his concerns. 5:23 p.m. Bob Haller moved, Ed Larsen seconded to adjourn the meet ing. Motion carried.
