The next day Mr. Keed was displeased upon looking around to discover that instead of a lertile little orchard and farm he was the possessor of a cross between a stone quarry and a gravel pit. A slide of rocks and other extraneous matter hud covered his laud to a depth 01 several feet. It is alleged thai he t.sik up several placer claims near his mine, yet never worked them, but he cut all the timtier off the claims ami con sumed it in the operation of the Col con. la. The government demands pay ment for this timber and the case In .our: is for the purpose of enforcing payment. Mr. P.nglish's contention is that he had a right to the timber which na- mcessarv to enable him to operate his mine.
