Between n and ' o'clock on Thursday
evening, I'ecemtier JO, u large quantity
of land came down from the mountain
side "like a wolf on the fold" about
four miles welt of Bonneville and
covered the O. It. A N. track to a
. lenth ol several leet. This caused a
delay to travel. No. S, which went
west through Pendleton at 10:40 last
night, got a- tar as tin- obstruction and
was then compelled to turn back. It
went east a No. li this alterm-m hIhuii
H hours late Ileal No. i. leaving Port
land last evening got to the obstruction
and likewise turned back.
The -lide occurred at what i- known
as the Keed place. About eight years
ago Mr Keed had a nice little 'farm
there one day. The next day Mr.
Keed was displeased upon looking
around to discover that instead of a
lertile little orchard and farm he was
the possessor of a cross between a
stone quarry and a gravel pit. A slide
of rocks and other extraneous matter
hud covered his laud to a depth 01
several feet. The railroad track was
covered witli from three to lour leet ol
the same kind of material lor a dis
tance of 200 yards. Instead ol shovel
ing the rocks and dirt off the track
tbev rebuilt tin railroad right over it.

The case is being heard today in
circuit court before County Judge Hart
man. Mr. Curl, who desires to have

He makes general and specific charges
against the manner in which Mr.
Kuiitli has conducted his guardianship,
such as failure to make his reports,
neglect ol the education ol the child
ren, etc.
It is . i. nine.: that the properly of
the two children now amounts in value

judge, and that he should he dis
chargeU lot cause from his position of
guardian, and another one appointed
in bis stead.

his preliminary hearing before Justice

L. p.dwards, who was robbed of live
ISO gold pieces, told his story. Mrs.

teetliled that Colter was the
man she saw with Mr. Pdwar.l- in
front of her store on Court struct
Thursday afternoon, and that he was
in the lead in a footrace that followed.
Mr. P.dwards a close second. Marshal
HMthman and William Hickey also
testified for the state. Win Krehs,
John P. Kussell and the delendant
were witnesses tor the defense. Mr.
bolter denied ell connection with the
affair and -fated that he hadn't seen
Mr. p.divards lor some time before the
robbery is alleged to have been com

was the man who grablied him and

Judge Bellinger's court in Portland
with cutting timber on government
laud. It is alleged thai he t.sik up
several placer claims near his mine,
yet never worked them, but he cut all
the timtier off the claims ami con
sumed it in the operation of the Col
con. la. The government demands pay
ment for this timber and the case In
.our: is for the purpose of enforcing
payment. Mr. P.nglish's contention is
that he had a right to the timber
which na- mcessarv to enable him to
operate his mine.
Probably, in considering this case
it will Ih shown that not only govern
ment property has been consumed in
a private business but, in addition,
lue property created through the use of
public property has not contributed a
wnt of support in the form of taxes to
the support of the government, al
though the (iolcomia mine is one of
the "fabulously rich" ones of the
Baker district.
