It Is not Intended that these field deputies r Inspectors shall in any way sup plant the regular peace officers of the various political subdivisions of the state, the purpose being merely to appoint ' additional officers to further aid In carrying into effect the requirements of the law provid ing for the registration of motor vehicles and the licensing of oper ators and chauffeurs. It being the desire of the secretary of state that such field deputies or inspectors as may be appointed by him shall co operate to the fullest extent with the regular peace officers, and in order that there may be a uniform understanding of the provisions of Go Ti.rt ?w the law, there has been prepared a compendium of the Oregon motor vehicle law. (chapter 29S. general laws of Oregon. 1919). and the mo tor vehicle operator' law, (chapter 3. general laws of Oregon, special session. 1920). a copy of which, to gether with complete copies of both laws. Is being enclosed herewith. By carefully reading these, it Is be lieved that the various officers con cerned will be enabled to fully ef fectuate the purpose of the law. "Within three or four weeks this department will have completed the issuing of operator's or driver's licenses for all applications received up to that time, and there should be no further delay in enforcing that provision of the law requiring that such a license be In the posses sion of every operator of a motor vehicle within the state. In due time the field deputies or Inspectors appointed by the secretary of state will visit the various communities with the view of co-operating fully with the local officers and aiding and assisting them In enforcing the provisions of the law. The secre tary of state desires that the fullest publicity be Riven the different pro visions of the law in order that the tesidents of every section of the state may be familiarized therewith and their co-operation enlisted in the ob servance of the same.. If there are sections ' of the law wherein the language Is apparently not clear, or where a doubt arises as to the proper construction thereof, this office will be pleased to aid you In any possible way. and if there should be a differ ence of opinion as to the meaning of any provision, we will, upon re quest, secure an official Interpreta tion thereof from the attorney gen eral. "The belief has developed in some sections of the state that persons under the age of It years may. un der circumstances, obtain licenses or permits to operate motor ve hicles. Such - Is not the case. The operator's law (section 4. chapter 3. laws special session. 1920) specifi cally prohibiu the Issuance of a license or permit to any person un der the age of IS years, whether or not such person be the owner of a motor vehicle, and the same section further enacts that no person, who Is the owner, or custodian of any motor vehicle, shall permit any per son who Is less than 16 years of age to operate or drive anl such motor vehicle or employ any person to operate or drive any such motor vehicle who Is less than 18 years of age and a licensed operator or chauffeur. "Section S of this lay provides for the issuance by the secretary of state of special licenses or permits to per sons who are physically incapacitated and the term 'phsically Incapacitat ed' is defined to Include 'any person who has lost the use of one hand or one foot, or yno has lost the use of both feet, or whose eyesight or nearing.are greatly impaired.' The impression seems to exist among some that under the terms of sec tion 5. a special license or permit may be issued to a person under 16 years of age. but the attorney gen eral nas neia that such a conclusion is erroneous. In no part of the law is there any authority riven to the secretary of state or any other oincer to issue to a person less than is years oi age a license or nermit to operate a motor vehicle, .under any circumstances whatever. "gome doubt has also arisen with reference to the status under thl lay of a non-resident motor vehicle operator. Upon this point the at torney general has ruled that while the operator's law is silent in this lespect. yet by reason of the, tm'rt that the motor vehicle law. of yhlch the operator's lay Is a Dart, do specifically exempt non-resident owners from registering their cars, by a logical reasoning it must b assumed that the legislature Intend- ea to exempt non-resident operators irom oDtatning operators' licenses or permits. .. The. amounts of $3.7i for costs of the suit snd disburse ments and 1100 was awarded the plaintiff. - The decree was signed by Judg9 O. G. Rlngharrt. The case waa heard on June 28. 1920. and no legal bat tle was encountered, the defendants defaulting when they did not appear In court, or make answer to the summons. The snch time as the legislature shall meet and correct the problem by appropriate legislation. For this reason the field deputies or inspec tors who shall be annotated by the secretary of state, to aid the regu lar peace officers in the enforcement of the provisions of the motor ve hicle law.- will be instructed not to enforce the operator's license re quirement as to non-resident oper ators when . operating their motor vehicles In passing through this state within the period of the exemption provision.
