Discus sion of the letter Indicate that the limited vacations now assea woum n be disapproved If confidence In the rail road company's alncerlty is connrmea. He promises that the main tracka on Eaat Second , and Third atreeta Will be kept clear to serve the spur tracka of eaat ' side business houses. Apparently. Mr. O'Brien had taken great care that the railroad's attitude ahould be fully stat ed. His letter follows: O'Brien's Letter. Doctors Advised Operation Decided To Try Great Kidney Remedy I want to tell you In a few words what Dr. Kilmer's Swamp-Root did for me, believing that my testimony may do some other suffering person a great .deal of good. About six years ago, I was danger ously 111, consulted three doctors," all of whom said I had kidney trouble. One of the doctors analyzed my urine and reported that I had gravel, and further aa!d that in order to regain my health and life, an operation would be neces eary. I did not want to be operated on, as I was afraid that I would not re . cover. Some one told me of Dr. Kll mer"s .Swamp-Root and eaid it was a re liable medicine for kidney trouble, so I decided to try it and went to Mr. Rose, the druggist, at 303 Central Ave., Min neapolis, and bought a bottle, took It, noticed results ar.d continued taking it until I was entirely cured. 1 Having been free Jrom- any kidney - trouble for over six years. I consider - that I am absolutely cured and know that Df, Kilmer's Swamp-Root has the , credit. I never fall to tell my friends about your remedy, as 1 believe It is the best of Us kind. Your U & O Ointment is also:, very good. We are never without a 1ar In our house. Yours very truly, - MRS. MARGARET E. ANDERSON. V. -. . ' Minneapolis, Minn. State of Minnesota." ) i County ij Hennenin- 1 "" Personally appeared before me this : lid day of Sept., 1909, Mrs. Margaret E. Anderson of the City of Minneapolis of . - the State of Minnesota, who subscribed the above, and on oath says that the . same Is true la substance and in fact -', ' M. M. KERRIDGE, t v -" , i - Notary Public ; Commission expire March 26, 1914. work, for which we have an approprla tlon at the present time. In connection with the construction of new freight house and tracka, of approximately 1190,000, which we are authorised to eipond as soon aa the necessary ar rangement can be made for the use of the streets under the conditions named above. "Inasmuch as East Flanders street will simply be crossed by the leads to 'the freight house, team and storage tracks, and cars will not stand on these tracks, we are willing to accept a fran chise embodying the right to lay tracka across this street A franchise will also be sufficient ss fsr as East Burn slde street Is concerned, for the reason that the team, streetcar and pedestrian travel along this street is at the level of the Burnslde bridge approach and will therefore not be Interfered with in any way by the operation of the yard be neath. "In connection with the foregoing, would call your attention particularly to the following facts: "First A.M..j KVAetk ot property be tween East Oak and Ankeny streets and between East First street and the waterfront, whom It seems to me are the only persons affected by the vacations desired, have already signed a petition ssklng that these vacatlona. be granted. "Second The ground space In the street which are requested to' be va cated. In the aggregate amounts to only 72,000 square feet (an area less than two city blocks); the streets In their present conditions are of absolutely no use or value to anyone, and even If they were opened up by the city, they would be of no service to the public for the reason that they abutt on Eaat First street, and do not reach the waterfront, and the railroad company, naturally, would not sell or consent to have any of Its property between the water front and East Second street used for any purpose which would Involve the cross ing of tts tracka at, grade by team or peedatrlan travel, which could only be done at great risk of Injury and pos sible loss of life on account of the switching necessary In connection with the operation of present tracka on East First and East Second streets, and the other track developments, as shown on the blue print enclosed. "Third The freight house and team track roadways, shown In solid white In the blue print, represent In the ag gregate, -207,660 square feet (an area of more than five city blocks). These roadways are intended for the use of the public In reaching the proposed new freight warehouse and cars on team tracks adjoining same, and If there is any sentiment in connection with the vacation by the city of the streets re ferred to, we are perfectly willing to have these roadways as shown on this blue print, dedicated to the uae of the public as streets, and turned over to the city for uae as such. Begin la 80 Says'. Fourth Under the proposed arrange ment, the railroad company Is agreeable to giving the city any rights to build overhead viaducts across the streets re ferred to, also the right to lay sewers conduits' and pipe lines beneath said streets, without any restrictions except that the work ahall be done under the supervision of a representative of the railroad company, to insure Its being performed In a safe and workmanlike manner, with proper clearance, to avoid risk of Injury or loss of life to the employes, and damage to the property which will be switched over the tracks laid on the streets. "Fifth Work-will be started on these Improvements within 20 daya after vaca tion of the streets referred to Is granted, and pushed to completion, as far ss the amount of money now appro priated for thla work, namely. 1100.000. wm go, ana future development over and above this expenditure will be made as faat as the additional facilities are required. "Sixth Under this arrangement, the Oregon-Washington Railroad & Naviga tion company will be in position to ac cept freight at East Portland warehouse until 4 p. m. each day, when sucti busi ness will be switched to the west side, unloaded into warehouse and reloaded into cars so that shipments will go forward on the same day, affording east side business the same service which Is now being given west side busi ness. The same arrangement will also an- ply aa far as the Southern Pacific lines In Oregon are concerned, as soon as we can provide the additional freight house tracks on the west side necessary to enable us to unload the business and rorward it the same day. faeventn Under the proposed track development shown on the blue print en closed, all team track business will be removed from East Second and East Third streets, which will permit free and unrestricted switching service to all industries located on those streets, mncn is impossioie under the present arrangement. "It seems to me that the neeessltv for additional team tracks on the east side, today, la greater than the neces sity for a freight warehouse. In fact, the team track carload business la be yond our present facilities, and If the east side expects to keep pace with the development on the wst side, we must be provided with the means of properly increasing our team track facilities." ML HOOD ROAD MUST CHANGE 16 CROSSINGS The Mount Hood Railroad & Power company was ordered yesterday after noon by County Judge Cleeton and Com misslonera Llghtner and Hart to give more attention to the highway crossings than ,has previously been given. The company was specifically Instructed to change 16 crossings, where the grades are steep. A visit over the highways where the railroad crosses them was made by the members of the county court, and they round conditions very unsatisfactory. In most places, the company has failed to make the grade specified in their permits to cross the highways. Super lntendent of Roads Chapman was also instructed by the court to make frequent visits to the crossings to see that they are made safe and in proper shape for travel on. the highways.
