will simply be crossed by the leads to
'the freight house, team and storage
tracks, and cars will not stand on these
tracks, we are willing to accept a fran
chise embodying the right to lay tracka
across this street A franchise will
also be sufficient ss fsr as East Burn
slde street Is concerned, for the reason
that the team, streetcar and pedestrian
travel along this street is at the level
of the Burnslde bridge approach and will
therefore not be Interfered with in any
way by the operation of the yard be
neath. "In connection with the foregoing,
would call your attention particularly
to the following facts:

waterfront, whom It seems to me are the
only persons affected by the vacations

"Second The ground space In the
street which are requested to' be va
cated. In the aggregate amounts to only
72,000 square feet (an area less than
two city blocks); the streets In their
present conditions are of absolutely
no use or value to anyone, and even If
they were opened up by the city, they
would be of no service to the public for
the reason that they abutt on Eaat First
street, and do not reach the waterfront,
and the railroad company, naturally,
would not sell or consent to have any
of Its property between the water front
and East Second street used for any
purpose which would Involve the cross
ing of tts tracka at, grade by team or
peedatrlan travel, which could only be
done at great risk of Injury and pos
sible loss of life on account of the
switching necessary In connection with
the operation of present tracka on East
First and East Second streets, and the
other track developments, as shown on
the blue print enclosed.
"Third The freight house and team
track roadways, shown In solid white
In the blue print, represent In the ag
gregate, -207,660 square feet (an area of
more than five city blocks). These
roadways are intended for the use of
the public In reaching the proposed new
freight warehouse and cars on team
tracks adjoining same, and If there is
any sentiment in connection with the
vacation by the city of the streets re
ferred to, we are perfectly willing to
have these roadways as shown on this
blue print, dedicated to the uae of the
public as streets, and turned over to the
city for uae as such.

Fourth Under the proposed arrange
ment, the railroad company Is agreeable
to giving the city any rights to build
overhead viaducts across the streets re
ferred to, also the right to lay sewers
conduits' and pipe lines beneath said
streets, without any restrictions except
that the work ahall be done under the
supervision of a representative of the
railroad company, to insure Its being
performed In a safe and workmanlike
manner, with proper clearance, to avoid
risk of Injury or loss of life to the
employes, and damage to the property
which will be switched over the tracks
laid on the streets.
"Fifth Work-will be started on these
Improvements within 20 daya after vaca
tion of the streets referred to Is
granted, and pushed to completion, as
far ss the amount of money now appro
priated for thla work, namely. 1100.000.

as faat as the additional facilities are
required.
"Sixth Under this arrangement, the
Oregon-Washington Railroad & Naviga
tion company will be in position to ac
cept freight at East Portland warehouse
until 4 p. m. each day, when sucti busi
ness will be switched to the west side,
unloaded into warehouse and reloaded
into cars so that shipments will go
forward on the same day, affording
east side business the same service
which Is now being given west side busi
ness.
The same arrangement will also an-
ply aa far as the Southern Pacific lines
In Oregon are concerned, as soon as we
can provide the additional freight house
tracks on the west side necessary to
enable us to unload the business and
rorward it the same day.

Oscar Figman, the famous comedian
who is playing at the Helllg theatre 1
"Madame Sherry," has Just purchased
a 40 acre fruit ranch near Medford, Or,
and intends to come out there this sum
mer to look after it. Thin wlll.be hi

been employed continually in the gen
tie art of making people laugh, with
only an interval, of a week or two be
tween engagements. For the past three
years Figman has been playing the
principal comedy role in "The Merry
Widow, and was seen on two different
occasions In Portland in that musical
production. Previous to, that he ap
peared here In "The Tenderfoot" and
"The Burgomaster," playing the star
part In eaoh musical comedy.
ML HOOD ROAD MUST
CHANGE 16 CROSSINGS
The Mount Hood Railroad & Power
company was ordered yesterday after
noon by County Judge Cleeton and Com
misslonera Llghtner and Hart to give
more attention to the highway crossings
than ,has previously been given. The
company was specifically Instructed to
change 16 crossings, where the grades
are steep.
A visit over the highways where the
railroad crosses them was made by the
members of the county court, and they
round conditions very unsatisfactory.
In most places, the company has failed
to make the grade specified in their
permits to cross the highways. Super
lntendent of Roads Chapman was also
instructed by the court to make frequent
visits to the crossings to see that they
are made safe and in proper shape for
travel on. the highways.

Arrested for Nonsupport.
Samuel Crossman, an expressman, was
arrested this morning by Deputy Sher
iff Salisbury on a charge of nonsupport,
soon after he had given his wife $1 for
the expenses of the household for today.
Crossman declares bis wife played him

his home after she had been away six
years.

Absence did not make the heart grow
fonder In the case of Austin C. Rice
and Ada A. Rice, who agreed In Novem
ber, 1903, to live apart six months and
see If their marital troubles would not
blow over. This morning Mrs. Rice ap
peared before Presiding Judge Ganten-
bein for a divorce, and was granted the
same.
Mrs. Rice said trouble had existed be
tweeji herself and husband for several
months previous to their separation In
1909, and they agreed to. separate for
six months and try an experiment of the
old proverb.
Mable E. Osman secured a divorce
from Elmer A. Osman, whom she mar
ried in 1902 at Rainier. She charged
that he deserted her in 1909 at Oregon
City.
Florence FI. Fletcher was given a de
cree from Albert Fletcher. They were
married In 1900 at Lexington, Ky and
separated April 11, 1911.
E. A. Barlow was allowed a divorce
from Lola M. Barlow. . They were mar
ried In 1907 at Vancouver, Wash, and
she deserted him ; two years later. '
ADMINISTRATORS OF
SCOTT ESTATE FINISH
The final report of the administrators
of the estate of Harvey W. Scott, de
ceased, -was filed. In the County court
this morning. The sum of $17,117 was
allowed the executors for the adminis
tration of the estate and $2000 for at
torney fees, The value of the estate Is
declared to be f 849,888. Inheritance tax
to the amounts 17540 is set out in
the report, and this amount has been
turned over fo the state. The sura of
$7000 is set aside for a monument for
the deceased. 1 Margaret Scott, and Les
ter Scott have been thek administrators.

Resolutions Indorsing the proposed
charter amendment for the construction
of a high bridge across the Willamette
