One of. the gravest of his majesty's judges has created a strange precedent by holding court Jn a music hall, and witnessing the perform ance of two rival vaudeville "turns" as a practical way of deciding an Issue. The case was an. action for Infringe ment of theatrical copyright brought by Fred ". Karno, who v-runs music ', hall "sketches" or playlets, against Paths Freres, a. flfm of blograph film-makers: Karno had produced - a sketch called "The Mumming Birds." a burlesque on a music hall performance. The Pathes had published a film called "At the Mu sk; Hall," which contained similar in cidents to some of those In the Karno sketch. : The rase came "before "Justice Jelf, and after the case had been amged by eminent counsel it was suggested that his lordship should judge for himself whether the film was a -colorable imi tation of the sketch.
