This land is for the most part lying idle, covered with drift-wood and tide! grans, subject to the overflow of the tides, a continual expense with no income. Attempts have leen made in several cases to reclaim this land by dyking, but all efforts, so far, have Iteen of doubtful success. Land Fraud Trials Illegal. The United States Supreme Court has decided that the conviction of Ex-Representative . Williamson was illegal and has granted him a new trial. Williamson was convicted in the United States District Court at Portland for defrauding the (?bvern ment out of public lands. THUc Court, in rendering its de cision, pprings a surprise on the prosecution by. deciding that an entryman on public lands may agree to sell the same, even before making final proof, and that the Commissioner of the General Land Office exceeded his authority in ruling that an entryman in making final proof must make affidavit that he has not "bargained or agreed to sell or dispose of the land or any thereof." After expressing this opinion the Cort says: "We cannot perceive how, under the statute, if an applicant has. in good faith, complied with the re quirements of the second section of the 'timber and stone act and, pend ing publication of notice, has con tracted to convey, after patent, his rights to the land, his so doing 2&H Wlieu in Toledo Stop at the MERCHANTS HOTEL The Leading Hotel of Toledo RATES: Room and Board, f 1 per Day, and up .
