One Year S1-50 The policy of the Coos nay Tl ru-s will be Republican In politics, with the independence of which Fresllent Roosevelt Is the leading exponent Adaress All Communications to COOS BAY DAILY TIMES Marslifleld Oregon IMPORTANT QUESTION OF FOREST LAW IN MAINE In holding that the legislature has a constitutional right to pass laws regulating the cutting of timber on private lands, if the cutting is liable -to be detrimental to -the public wel fare, the judges of the Maine Su premo Court handed down an opinion of great importance to the owners of forest land In that state, and of Inter est to land owners In all parts of the country. Tho opinion refers particularly to the cutting of small timber which should be left growing to give a for est cover which will conseive the water and lessen flood ravages and prevent or diminish soil erosion and consequent filling up of the rivers and lakes. The judges specifically state that regulations of that kind cannot be construed as the taking of private property for public use, and that the state need not pay for young growth which It may forbid the own er to cut. This was not a court decision, for no case was before the court for r view, but was a formal opinion pre pared at the request of the senate for the guidance of the legislature in the enactment of laws to regulate forests and protect the interests of the pub lic. Similar questions have come up in other states and may be expected to come up in the future. Jn tho proposition which the Maine senato submitted to the judges for their opinion It was stipulated that a law should not be enacted which would Interfere with clearing land for agricultural, mining or manufac turing purposes, or for building sites, or plensure grounds. The purpose Is to forbid the total stripping of forest land where a forest cover Is necessary to prevent the wash of the soil, the lessening of flood ravages, and the mitigation of drought, and where the public good requires that such cover bo preserved. In submitting their opinion the judges cited numerous examples of legislation restraining property hold ers from using their propeity in such a way as to ondanger tho public wel fare. A man may not erect a dan gerous building on his city lot be cause It would Imperil or damage the property of others. For tho same reason, a forest owner may bo re strained from denuding his hillsides to such a degree as to send clown upon the lands of his neighbor the soil wnsh to covor their mendows, choke their streams, and Injure thorn In their rightful use and enjoyment of property. It was declared that thero Is nothing In tho constitution! or tho united states or in that of tho state or Maine prohibiting the enfor cement of a forest law of that kind. Mnlno's greatest wealth Is In Its forests directly or Indirectly. In several ways it has been a pioneer In forest legislation and manage ment. NICARAGUA TO AID HONDURAS South American Revolution May Assume Unexpected Pro portions Within Few Days (By Associated Press.) WASHINGTON, D. C, July 9. Nicaragua has taken up arms in sup port of Honduras which has a revolu tionary movement on Its hands, ac cording to advices to tho United States State Department today. All say that he has done good work, and that the scraper is a success, and much more economical than the old way of repairing our roads. James K. Mack, the veteran print er and journalist, editor and prop rietor of a Fireman's journal of San Francisco, arrived in Port Orford from the north, on his annual outing to this section to keep up his health and to greet his old friends with a hearty hand clasp. He went down the coast on his bicycle. Both Skipper and Red Tip ore standing training well, and will be In condition to meet all comers at the Marchmont races in August. They are very beautiful horses, and top notchers In breeding and speed. It is said that there are some high-class horses to be there to make them run for their laurels. Humes hatchery at the mouth of Rogue river turned out over a mil lion young salmon last week. They had been fed until they were several inches long, and so strong and active as to elude their enemies. Mr. Hume's method of feeding young sal mon has revolutionized the propaga tion of salmon by artificial means, and Is one of the greatest forward steps ever discovered. W. E. Burrows of Ophlr was In Port Orford on his way to Tennessee to visit his people, and dispose of a farm which he owns in that state. He has patented a clevis pin which cannot fall out, and has made ar rangements In St. Louis to have them manufactured, and while in the East he will have them put on the mar ket.
