IMPORTANT QUESTION OF
FOREST LAW IN MAINE
In holding that the legislature has
a constitutional right to pass laws
regulating the cutting of timber on
private lands, if the cutting is liable
-to be detrimental to -the public wel
fare, the judges of the Maine Su
premo Court handed down an opinion
of great importance to the owners of
forest land In that state, and of Inter
est to land owners In all parts of the
country.
Tho opinion refers particularly to
the cutting of small timber which
should be left growing to give a for
est cover which will conseive the
water and lessen flood ravages and
prevent or diminish soil erosion and
consequent filling up of the rivers
and lakes. The judges specifically
state that regulations of that kind
cannot be construed as the taking of
private property for public use, and
that the state need not pay for young
growth which It may forbid the own
er to cut.
This was not a court decision, for
no case was before the court for r
view, but was a formal opinion pre
pared at the request of the senate for
the guidance of the legislature in the
enactment of laws to regulate forests
and protect the interests of the pub
lic. Similar questions have come up
in other states and may be expected
to come up in the future.
Jn tho proposition which the Maine
senato submitted to the judges for
their opinion It was stipulated that
a law should not be enacted which
would Interfere with clearing land
for agricultural, mining or manufac
turing purposes, or for building sites,
or plensure grounds. The purpose Is
to forbid the total stripping of forest
land where a forest cover Is necessary
to prevent the wash of the soil, the
lessening of flood ravages, and the
mitigation of drought, and where the
public good requires that such cover
bo preserved.
In submitting their opinion the
judges cited numerous examples of
legislation restraining property hold
ers from using their propeity in such
a way as to ondanger tho public wel
fare. A man may not erect a dan
gerous building on his city lot be
cause It would Imperil or damage the
property of others. For tho same
reason, a forest owner may bo re
strained from denuding his hillsides
to such a degree as to send clown
upon the lands of his neighbor the
soil wnsh to covor their mendows,
choke their streams, and Injure thorn
In their rightful use and enjoyment
of property. It was declared that
thero Is nothing In tho constitution!
or tho united states or in that of tho
state or Maine prohibiting the enfor
cement of a forest law of that kind.
Mnlno's greatest wealth Is In Its
forests directly or Indirectly. In
several ways it has been a pioneer
In forest legislation and manage
ment. It Is one of tho few states
probably tho only state whoso for
ests are nearly holding their own
Lumbering has gone on there for a
long tlmo, and every year thero Is
something ready to cut. Tho folly
of stripping Innil and leaving It de
fonsolcss against erosion Is woll un
derstood In Maine, and tho legisla
ture has taken the preliminary Btops
toward a law to compel unwilling
forest land owners to leave enough
small tlmbor nnd brush on tho
ground to cover It.

GOOD EVENING.

THE REAL PROBLEM.
Did you ever try to do the things
they say cannot be done,
To ride three In a canoe where
there's room for only one?
Did you ever light the furnace when
there wasn't any gas,
And then have to use the scissors
when you cut the front yard
grass?
Did you ever try to row a boat with
out a pair of oars,
Or avoid that usual morning-after
feel-of remorse?
Did you ever try to show your wife
she had no business sense,
Or argue with a tenant who desires a
cut In rents?
Those are things that often happen
they happen every day.
Why, they're not at all unusual, but
there's not a single way
To solve the vexing problem, the one
that knocks you flat,
Of the narrow little doorway and the
Merry Widow hat.
ANON.
It is all right to be economical:
The trouble with some people Is that
they carry economy so far they look
like a cold potato.
The girl who has several good
looking brothers always has lots of
friends among the other girls, who
call at her house to see her.
If a man's family matches his
wife's In present and future pro
spects, she goes into the past and
digs up an heirloom that puts her
family ahead.
You can usually flatter a man by
telling him he works too hard. He
may do nothing but loaf, but he Im
agines his great need Is rest.
When a man sees anything In the
paper that Is a lecture to women, he
.s sure to read It aloud. The good
advice to men he scorns to look at.
Too much attention Is paid to the
higher life, and not enough to the
lower. In trying to be an eagle, a
gosling often spoils a good goose.
People should be polite, of course,
but when they are being bored, they
have a right to respectfully represent
the fact to the person who Is boring
them. If the people did not express
their disgust, where would the bores
stop?
An Open Letter to the Man

Do jou know that "Tho Gunnery" Is the only exclusive sport

that tho man who makes n specialty of ono lino is in a better
position to glvo you satisfactory scrvk-o than ono whoso time
