"Loser-Pays, Tort Reform, Lia bility Cap": What ever you call this monstrous intrusion upon state laws and the health and well-being o f A m erica's citizens, the Republican push for this legislation exhibits the depth o f depravity to which both old and neophyte politicians have sunk - - trying to build banks o f deep-pock et, corporate campaign contributors for future elections (yesterday the little rascals wanted money, power and clout returned to the states. Now, they want a "nation-wide” federal cap on awards in civil suits). The grand rush to limit the amount o f damages which an injured party may recover at law - either actual or for pain and suffering - will no doubt be accelerated by the recent national exposure o f two horrendous 'accidents' at a Florida hospital. First, a man has the wrong leg amputated; a week later, the very same facility' kills a patient by ‘mistakenly’ re moving his breathing apparatus. The house measure which for the first time set limits in “All o f The Nations Courts” on damages awarded in all civil lawsuits is being enthusiastical ly backed by many associations and industries. S u p e r-in te n se lo b bying, o f course, comes from hospitals who along with physicians and pharma ceutical companies have succeeded in being gadded to the house bill The American Medical Association is spending millions on radio and newspaper advertisements. Are they afraid that the public will forget the deliberate and deadly withholding o f known facts concerning Asbes tos? T ham alom ide” Breast Im plants? Deadly Hamburgers? 1 hope we are not fooled by a few highly-publicized examples of excessive damages like the recent million-dollar hot coffee incident. In concert with these attacks upon the publics right to fair and just compensation for injury , loss o f in come and for pain and suffering, we have parallel assaults upon the Food And Drug Administration (FDA) by the pharmaceutical companies. If, two decades ago, the FDA had been crippled as the Republicans with, they would have approved the drug Tham alom ide and here in America, we too would have had the many thousands o f horribly de formed babies as in Europe. No, our system o f law is not perfect but it is so superior to that in the rest o f the world that even a fool (or Republican) should think twice before arrogantly tamper with it. Nothing said here should be taken as blanket endorsement o f Demo crats; they have their rascals too, many o f the weaker ones joining the right wing assault.
