Calling the rule "innocuous,” the C ourt said, “ it sim ply provides a method by which C ity bureaus, o f fices, and departments may attempt to com ply w ith federal, state and City equal opportunity employment goals where they - not the Board - find and certify that such an attempt is w a rra n te d .” The rule does not require that C ity authorities request a second list or hire from it. The Court declared that the rule does not result in less qualified em- ployees since all who are on the list have received a passing score and are thereby deemed qualified. The applicants score is not the only fac to r that can be considered fo r hiring, therefore frequently a person with a lower score might be hired. The Court determined that there is no evidence that the rule discrimi nates against the Police Association or its members, or that it w ill prom ote in tergrou p h o s tility , re sentment, distrust or tension. The "tw o -lis t” rule was proposed by Commissioner Charles Jordan in an e ffo rt to assist C ity bureaus, in cluding the Police Bureau, to hire minorities and to reach affirm ative action goals.
