W. DOB: 11/2/2010 SEX: MALE Child Under the Age of 18 Years NOTICE OF SUMMONS TO: JAMES KEENER SHAVELL WEAVER ANY UNKNOWN BIOLOGICAL FATHER You are hereby notifi ed that the Baldwin County Department of Family and Children Services, and the Georgia Department of Human Services, has fi led a Petition to Terminate your parental rights in the Juvenile Court of Baldwin County, Georgia. A copy of said Petition is attached to this summons or, if this Summons is served by publication, can be obtained from the Clerk of this Court during business hours, and may fi le with the Clerk of said court, and serve upon Thomas J. O’Donnell, Jr., Petitioner’s Attorney, whose address is P.O. Box 1366, Milledgeville, Georgia 31059, an answer to the motion at any time prior to the fi nal hearing. You are hereby notifi ed that a fi nal hearing, with regard to the above-styled action, will come before the Court on the 2 Day of April, 2015, at 8:30 a.m. in the Juvenile Courtroom at the Baldwin County Courthouse, Milledgeville, Georgia. Georgia law provides that you can permanently lose your rights as a parent. This summons requires you to be present at a formal hearing in the Juvenile Court. If you fail to appear, the court can terminate your parental rights in your absence. If the court at trial fi nds the facts set out in the petition to terminate parental rights are true and that termination of your rights will serve the best interest of your child, then the court can enter a judgment ending your rights to your child. If a judgment terminates your parental rights, you will no longer have rights to your child. This means that you will not have the right to visit, contact, or have custody of your child or make decisions affecting your child’s earning or property. Even if your rights are terminated: (1) You will still be responsible for providing fi nancial support (child support payments) for your child’s care unless and until your child is adopted. (2) Your child can inherit from you unless and until your child is adopted. This is a very serious matter. The child or other parties involved may be represented by a lawyer at all stages of these proceedings. If you want a lawyer, you may choose and hire your own lawyer. If you want to hire a lawyer, please contact your lawyer immediately. If you want a lawyer, but are not able to hire a lawyer without undue fi nancial hardship, you may ask for a lawyer to be appointed to represent you. The Court would inquire into your fi nancial circumstances and if the Court fi nds you to be fi nancially unable to hire a lawyer, then a lawyer will be appointed to represent you. If you want a lawyer appointed to represent you, you must let the Court or the offi cer of this Court handling this case know that you want a lawyer immediately. The party notifi ed hereby is entitled to legal counsel in the proceedings, and the Court will appoint legal counsel if any party should be unable, without undue hardship, to employ counsel. Whether or not you hire an attorney, you have the right to attend the Hearing on your case, to call witnesses on your behalf, and to question those witnesses brought against you. You are further notifi ed that a party to this proceeding who is the biological father but not the legal father loses all rights to the child and will not be entitled to object to the termination of his rights to the child unless, within thirty (30) days of receipt of such notice, you fi le a petition to legitimate the child pursuant to Code Section 19-7-22 and fi le a notice of the fi ling of the petition to legitimate with the court in which the action under this Code Section is pending. If you have any questions about this notice, you may call the telephone number of the clerk’s offi ce, which is 478- 445-4007. WITNESS, the Honorable Philip B. Spivey, Judge of said Juvenile Court. The previous Master Plan approval for Area C was approved by City Council Order dated March 18, 2013 that approved both Master Plan Case 2010-16 and Subdivision case 2010-18. The applicants do not intend to subdivide the property so that approval will be rendered null and void. The applicant’s request is to modify the existing master plan approval and master plan site plan in 2 specifi c areas, with the majority of the original approval remaining unchanged. The changes proposed are limited to the following: • The 53,000 square foot medical center is proposed to be replaced with a 150 unit senior living retirement facility. • The number, specific location, and design of the individual buildings within the areas designated for multi-family development are proposed to be modifi ed. The proposal seeks to modify the multi-family area of the master plan with regard to building design and location while meeting the previously approved density allotment. In addition, the city has encouraged the applicant to revise the site plan to refl ect the maximum development of up to 80,000 sq. ft. of a larger format retail building. Area C has frontage along the south side of Lockhaven Drive, along the west side of the Burlington Northern – Santa Fe Railroad tracks, along the east side of McLeod Lane between Chemawa Road and Lockhaven Drive, and along a portion of both sides of Chemawa Road. Area C also includes frontage along both side of an unnamed unimproved right of way north of the Keizer Church of Christ. St. Croix, Ridge Drive, and a portion of Chemawa Road east of its new realignment are to be vacated as part of the development. The master plan application encompasses all of Area C. Area C is designated Commercial and Mixed Use on the Comprehensive Plan Land Use Map and is zoned MU (Mixed Use) and a portion of the site is zoned CR (Commercial Retail). While Area C is comprised of approximately 33.92 acres, the portion affected by this proposal is approximately 17 acres. LAND USE DECISION CRITERIA: The criteria upon which the decision on this matter will be based can be found in Section 3.113 (Keizer Station Master Plan Review) and Section 3.106 (Lot Line Adjustment) of the Keizer Development Code. DATE AND TIME OF HEARING: Tuesday, January 20, 2015 at 7:00 PM. LOCATION OF HEARING: Keizer City Council Chambers, Keizer City Hall, 930 Chemawa Road NE, Keizer. HOW TO PARTICIPATE: Anyone desiring to speak for or against the proposal may do so in person, or by representative, at the public hearing or may submit written comments with the Keizer Community Development Department prior to the public hearing. Written comments may be fi led with the Keizer Planning Department located at Keizer City Hall, 930 Chemawa Road NE, Keizer. The fi le with the staff recommendation relating to the above land use case may be reviewed at no charge or copies may be obtained at City Hall for a reasonable cost. After the close of the hearing the City Council will approve the application as submitted, approve with modifi ed conditions, deny, or refer to the Planning Commission for additional consideration. Interested persons should become involved in the decision making process. Failure to raise an issue, either in person or in writing, or failure to provide suffi cient specifi city to afford the Council an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue. Applicant’s statement, proposal, and all submitted documents can be viewed on the City’s web site, www.keizer. org. Choose from the menu on the left “City Departments”- “Community Development” – “Planning & Zoning” lastly “Current Land Use Actions”.
