T he follow ing reasons for this w as given the council by O. D. ¡ - ‘..p . re p re se n tin g th e planning commission. 1. A city h as th e pow er to am end a zoning ordinance if th e re has been a su b stan tial ■ chan g e of conditions and th a t change is in th e fu rth e ra n c e of P u b lic in terests. 2. A lthough a C ity Council has w ide d iscretio n in en actin g zoning ordinances, it h as no rig h t to place re stric tio n s on one p erso n ’s p ro p e rty and by m ere favor re m ove such re stric tio n s from a n o th e r’s p ro p erty . A ccording to figures released 26,382 vehicles passed th ro u g h thp sta tio n tag g ed as S m ith R iver. Of these, 9,388 w ere C al ifornia passenger cars, and 16,* 994 w ere “ foreign”. T he to tal n u m b er of A utom o biles e n te rin g C alifornia th ro u g h all p o rts of e n try w ere 434,170 co m p ared w ith 431.545 last year. T he 16,994 fig u re at S m ith R iver com pared w ith only 3,501 e n te rin g in J a n u a ry , 4,125 in M arch. 7,337 in M ay, and a peak of 27,493 in Ju ly . It is a well established p rin ciple th a t th e v alidity of an am en d a to ry O rdinance depends on w h e th e r it tends to prom ote th e G eneral W elfare. 4. W hen a g en eral zoning o rd i nance has been enacted, p ro p e r ty ow ners o r persons buying p r o p - ' erty , have a rig h t to rely on th e 1 ru le of th e law —th a t the c lass ificatio n s m ade in the general ordinance, will not be changed u n less th e ch angb is req u ired for th e public good. 5. A p ro p e rty ow ner, who de sires to have his p ro p e rty re* classified shall first prove th a t th e req u ested re-classification J will be for th e public in tere st, h ealth , safety , and the public w elfare. 6. T h e fact th a t th e p ro p e rty j in q u estio n w ould be of m uch i m o re value if th e requested use or ch an g e be g ra n te d , is not a ground for re-zoning. 7. M erely th e benefits of a larg e in v estm en t is not a valid reason for re zoning. S. A ch an g e of zone o r d istrict m ust pro m o te th e G eneral W el fare of th e people at larg e and not for th e in te re st of any p ri v ate g ro u p o r individuals. 9.
